Act 10 is back in court. Here are the stakes for Wisconsin unions

The fate of Act 10, the controversial 2011 law curbing collective bargaining for public sector unions in Wisconsin, is back in court at a crucial juncture for organized labor in Wisconsin.

In a November lawsuit, a group of government-employee unions sought to strike down the law as unconstitutional just four months after the swearing-in of Justice Janet Protasiewicz, which tipped control of the Wisconsin Supreme Court to liberal justices.

The challenge to Act 10 must first progress through Dane County Circuit Court, where a judge heard arguments Tuesday over whether the lawsuit should be dismissed.

The dismissal was sought by lawyers representing the Republican-controlled Legislature and the Wisconsin Department of Justice, which is standing in for the state agencies named in the lawsuit.
