The action and accompanying rule from the Biden administration allows the president to close the border in between ports of entry when there is an average of 2,500 crossings a day over a seven day period. That threshold, administration officials said, has already been hit over the past week.
The announcement represents an aggressive attempt by Biden to bolster his standing on the border in advance of the November election. Biden is expected to use a speech on Tuesday to highlight his unilateral efforts to resolve the crisis, while congressional Republicans at the behest of Donald Trump killed efforts to pass bipartisan border legislation earlier this year.
The president will be joined later on Tuesday by members of Congress and local and state leaders from border cities and states, in an effort to project consensus and political strength on a topic that has long dogged him politically. Its expected to spur blowback from progressives and immigration advocates, who plan to speak out against the move Tuesday afternoon.

They're going to frame this as he should have done something all along. And his reply will be, I was negotiating with legislators to get a more comprehensive deal, but Trump killed it.

(26,156 posts)This is the same law former President Donald Trump who is challenging Biden in this year's election used in 2017 to ban immigration from several majority-Muslim countries, and in 2018 to suspend the entry of migrants between ports of entry along the Southern border. As it happened during the Trump administration, Bidens executive order is expected to be challenged by immigrant rights groups.

(24,930 posts)but I can't help it feels like Biden doing this validates GOP claims that he could have always done something via EO instead of working with Congress to pass something bipartisan- does this not take the GOP "off the hook" somewhat for blocking the bipartisan border bill?

(6,264 posts)for willingly blocking a central tenet of their party's platform at the expense of that central tenet of their party's platform. I kinda think it places them on the hook even more.

(1,870 posts)And for any criticizing this move, I think it is the best of the bad choices. No one has been able to solve immigration up to this point. It will not be solved 100 years from now. This is probably the best choice Joe can make at this point in time.

But Republicans in Congress have left me no choice.
So today, Im announcing actions that bar migrants who cross our southern border unlawfully from receiving asylum unless they seek it after entering through established lawful processes.
