deal was rescinded? Unless further evidence came to light that the defendant was hiding something else he didn't confess to in the plea deal, why pull it
If I were accused of something, and offered a plea deal, I'd think twice about accepting it now, because this case shows the prosecution can say they will give you a deal if you confess, but then not live up to their end of the bargain.
I'm not saying what he did was right, or he shouldn't be held responsible in some way, but unless there was a valid reason not too, it seems a bit unfair of the government to do a take back of the original plea.

(33,424 posts)The judge had to approve it. She asked Hunter's lawyers some simple legal questions about the terms of the deal and they were unable to give an answer. At that point the judge refused to endorse the deal.

(5,347 posts)It would be different, if the prosecution had promised him a deal, without intending to hold up their end of it, or they caved to political pressure.
That the judge asked and his lawyer's wouldn't answer does put the fault on the defense side then.

A more even handed report. And it wasn't just Hunter's Lawyer didn't know what they were talking about. A hint would be who the SC was.

On the video, she actually asked Hunter if he was clean from drugs today and he answered no. It was pretty arrogant to not get yourself in a program fast when you are about to go in front of a judge.

(620 posts)The future immunity deal. His lawyer was asking for future immunity from any federal prosecution. The prosecutor said no to any future stuff, but was accepting immunity for anything they were investigating now, and wherever it went.
So I think taking a plea deal where he refused to plead guilty ( he would do an Alred plea ) to a more minor charge to get immunity from more serious charges ( guilty or not ) I think was a step too far for the judge.

There's enough disinformation out there about Hunter without exploiting this to make some silly point about the AG.

(32,323 posts)Garland made Weiss a special counsel on Aug. 11, 2023, at the request of Weiss. Weiss had jurisdiction in Delaware to prosecute Hunter for his gun crimes and making him sc allowed Weiss to prosecute Hunter in California for tax crimes.
Hunter failed to pay 1.4 million dollars in taxes, however, he did pay his taxes plus the fines. This crime is rarely prosecuted but Hunter could get 16 years in prison if found guilty.
No word yet if Garland will appoint a sc to investigate the 100 million dollars that TSF stole from the government for claiming a 651 million dollar deduction on his Chicago tower. TSF then created a holding company to double dip on his deduction.
We don't know what DOJ is doing, it doesn't leak.

(3,096 posts)a firearms background check for isn't comparable to speeding tickets. It's a very serious offense to circumvent the system that is put in place to vet gun buyers. Granted, most people who do this are likely never caught so this is a case of drawing the short straw for sure, but the FBI and ATF don't take these things lightly, they generally have little mercy.
We'll know if he has been treated fairly when we find out the punishment. People go to jail all the time for far less serious crimes, but a max penalty or something will be completely uncalled for and unusual. If that happens, I will most certainly call foul.

(10,988 posts)According to Hallie, the gun was not secure in an unlocked truck and a danger for her kids as they sometimes spent time in Hunters truck. She then freaks because she says Hunter is unstable and throws the gun in a trash can across from a school. When she goes to retrieve the gun, its missing etc etc - law enforcement gets involved. The story has lots of drama with people close to him freaked out he has a gun.

(998 posts)What's screwed up is Hunter agreed to a plea deal on the taxes and gun charges. He admitted to a judge in open court he was guilty.
Then after the House Republican freakout a Trump appointed judge rejects the plea agreement.
At this point Garland should have just stayed out of it and let Weiss sort out this mess. Instead he caves into pressure from the House MAGA caucus and names Weiss special counsel.
He shouldn't have named a special counsel and definitely not Weiss. But Garland loves appointing special counsels. Especially Trump appointees who openly hate Democrats.
Feel bad for Hunter Biden getting caught up in this craziness. And it has to be hard for President Biden to endure all this.

(32,323 posts)and Garland granted Weiss his wish. It had nothing to do with Garland showing he wasn't partisan. Making Weiss a Special Counsel allowed him to prosecute Hunter in California. Trial starts Sept. 5, 2024 for crimes that are rarely prosecuted.

(37,370 posts)Usually resolved by paying the taxes and a fine, which is what Hunter did. Most others would never get prosecuted after they resolve it. Meanwhile Trump found guilty of Tax evasion in Civil Court is not charged.

(23,715 posts)he committed a crime and got prosecuted. He got a fair trial in front of a jury of his peers just like anyone else. He certainly DOES NOT deserve jail time and I hope the judge doesn't sentence him to any.

Its probably rarely prosecuted because its difficult to prove, but that wasnt the case here. Federal law makes what he did a crime and he is guilty. Now Congress can change the law (which wouldnt help Biden), but then folks would complain they are being soft on gun owners.

(32,323 posts)In 3 years he has convicted 2 Trump cronies who were involved in the insurrection: Steve Bannon and Peter Navarro for blowing off a J6 select committee subpoena. Not sure if Garland would have prosecuted them were it not for the criminal referral.
Bannon and Navarro got 4 months in prison, that should teach them a lesson. Navarro will be out in time to speak at the GOP convention where I assume he will tell everyone how sorry he is for being a part of an insurrection. No word if Garland is investigating Navarro for more serious crimes. DOJ doesn't leak.
