The New York Court of Appeals on Tuesday declined to hear former President Donald Trump's appeal of the gag order in the hush money case in which he was convicted last month.

The court said it was dismissing the appeal "upon the ground that no substantial constitutional question is directly involved."

Not sure if TSF can appeal this to his fascist court but the NY court just ruled there was no substantial Constitutional question. Is that a message to the fascist court?

Maybe they're saying that the fascist court is only supposed to hear appeals that ARE a substantial constitutional question? Maybe one of DU's legal eagles can jump in.

By the precedents they cite you will know them.

In Heller v. DC Scalia pulled the commerce clause out of his ass, even though it was NEVER mentioned in the lower courts.

And don’t get me on Alito! Or Thomas.

...interpret the word "substantial" to mean "under a stanchion" and therefore grant him the presidency for life based on a drawing from the second to last ice age which clearly shows a man, woman, tv, camera, and whale.

At some point he's going to have to fake a major health episode which he doesn't want to do since that will make him look weak to his cult members. But if that's all he has left, he would probably go for it. Of course, we all would like it to be a real health episode first and foremost, preferably a massive stroke where he is rendered unable to speak or move his accordion hands, but also lingers for a very long time.

I feel ya, Mr. trump; it's a tough old when you're not allowed as an adult to use cash and influence to intimidate the people holding you to justice. Watching your closest associates and allies getting convicted and locked up. Being forced to listen to your friends and family begging you for the money you owe them. Gosh, it's almost as though you're experiencing the consequences of your own flawed, dishonest, and corrupt actions (but we know the right payouts to the right people will nip that in bud, eh?)

In March, just before the trial started, Merchan granted prosecutors’ request for a gag order that precluded Trump from making public statements about any witnesses in the case, jurors, prosecutors, court staff, or members of their family. Trump was not restricted from commenting on the judge or Manhattan District Attorney Alvin Bragg.

After that he could try federal courts but they might not want to assert jurisdiction.

This isn't delaying anything. This is whether he can run his slanderous mouth.

I'm not sure if everyone is familiar with the appeal, but its a joke. He says, that since he is running for President(the basis), the court can't issue a gag order that prevents him from talking about Stormy Daniels and Michael Cohen OUTSIDE of the court. Ignoring that he rejected his right to dispute them on the stand and under oath(like they were), he argues his rights were violated because he couldn't talk about them on is social media feed to his fan club. He wants a new trial where he can talk about Daniels and Cohen before they draw a jury.

Legal absurdity. There is no "right to unfettered speech while under indictment if you are running for President" stated or implied in any federal statute or The US Constitution. No court is going to take up a case on the basis that the act of running for President gives a person extra rights, especially rights that would be over and above the powers granted to the Judicial system of this country.
