What does presumptive mean in law?
Presumption is a legal inference that must be made in light of certain facts. For example, in the case of In Interest of Keiss, the Appellate Court of Illinois, Third District defined presumption as a legal inference; a party challenging it can overcome the presumption by providing the appropriate burden of proof.
So sure sounds to me a president is presumed to have immunity on actions while president, however they can be challenged in court. So appears challenges would then be decided by a judge or jury.

(6,908 posts)1. Assuming you can get a decision
saying Trump doesn't have the presumptive immunity we still have no action taken by courts until well after this election, if ever.
Can prosecution say that the stuff he took was after he became a private citizen? Of can they say everything he held when asked to return it doesn't fall under the presumptive immunity clause.
Either way, the American public gets no justice befoer this election. So this court actively helped Trump avoid justice. Guilty or innocent.

I am still reading the opinion (it is hard because I keep getting mad). This flowchart purports to outline the effects of the decision on the prosecution of TFG.
If this is accurate, there can be a prosecution of TFG

There's a lot of misunderstanding of the Supreme Court's ruling in the presidential immunity #January6th case.

- the scope of immunity from prosecution for all future presidents
