Todays Supreme Court decision on Donald Trumps immunity claim is far worse than anything I imagined...
Effectively giving a president immunity for any crimes committed while in office as long as that president can plausibly claim the action was taken in some form of official capacity.
It must now be presumed that the president, as king, is immune from accountability.
The rule of law applies to everyone except the most powerful person on Earth.
It would be difficult to overstate how much this opinion shifts the balance of power away from Congress and towards the presidency, and how unshackled a corrupt president will now be. The Court gives the president absolute power, and it will corrupt him, absolutely.
As Justice Sotomayor says so powerfully, this new immunity now lies about like a loaded weapon for any President that wishes to place his own interests, his own political survival, or his own financial gain, above the interests of the Nation.
The Court holds that when a president acts within his core authority, he is fully immune.
And when he acts outside his core authority, but in an official capacity, the presumption of immunity is so strong as to be nearly absolute.
Even if he acts in a purely personal capacity, and the Court majority gives no indication of when that would be, his statements while acting officially may not be used as evidence, and his motives may not be questioned.
Having taken up a case they never should have, having waited until the last day to issue the opinion, having known it was the defendants strategy to deny justice by delaying it, the Court now remands the case for further proceedings of indeterminate length, ensuring there will be no accountability for Trumps insurrectionist crimes before the election.
During his abortive coup attempt, Trump told his acting attorney general and other top Justice Department officials to just say that the election was corrupt and leave the rest to me and the Republican congressmen.
Now the Supreme Court says he is immune from ordering his Justice Department to lie, and the evidence of his malice, his very words, may not be used as evidence against him.
Under this ruling, a president can order the assassination or jailing of their political rival, and be immune. They can take a bribe in exchange for an official act, and still be immune. They can organize a military coup to hold onto power, and still be immune. If that sounds mad, thats because it is.
This is a day that will live in legal infamy.
When justices on the Court that bears Roberts name, paid back their appointment by a corrupt president with an opinion that provides immunity to all corrupt presidents, and weakened our democracy and the rule of law for the ages.
Our only remedy is the ballot box, a new congress, and a new Court that has more reverence for the Constitution than the lust for power.

This court has done more to destroy democratic principles and norms than any court in my lifetime and perhaps in history. It rules for the wealth elites, those who are denying voting rights to minorities, those who want unfettered capitalism with no regulations to protect peoples health or safety, and the religious right that wants to deny all women the right to decide when and if they will become parents and the right to have life-saving medical care when a pregnancy has severe complications.

Illegally removing and replacing the 6 justices and then having the question reconsidered is an idea that comes to mind.

(22,456 posts)If so, then yes, remove the 6, charge with insurrection for this decision, detain them somewhere until a trial can be started, and in the meantime re-hear the immunity case.

It would be legal and it would be clean.
Or Biden just personally revokes their citizenship and orders them deported.
The remaining 3 can go about their court business and anyone can bring a case that would result in overturning this completely unconstitutional decision.
But since Biden does the kidnapping or deporting before it's overturned, it's all still legal (and fun).

Thanks to the Roberts Supreme Court for destroying 248 years of the longest running democracy in modern times and quite possibly extinguishing that light forever.

install Trump as POTUS the coup was there and on 1/6/21 players like Chuck
Grassley and all those phony electoral voters were into the coup big time. Todays
ruling by the SCOTUS is more of the same.

(3,554 posts)Is as notoriously bad, or worse, than Chief Justice Roger Taneys. And Taney was responsible for Dred Scott v. Sanford, the decision that said that enslaved people were not citizens of the United States and, therefore, could not expect any protection from the federal government or the courts. The opinion also stated that Congress had no authority to ban slavery from a Federal territory. And Dred Scott is widely regarded as one of the absolute worst rulings in SCOTUS history.
Fuck you, Roberts. And a huge fuck you to Clarence (Uncle Slappy*) Thomas, Scammy Alito, Justice Beerbong, Goresuck and the Handmaiden.

(114,585 posts)but I can't see anyone in the legal system particularly impressed by an erroneous belief, no matter how deeply held and how many anonymous bloggers backed that belief. Delusion has never impressed a judge or jury.
So even when His Corpulence will argue what a great patriot he is in doing everything to protect the country from an election that was clearly not in his favor, they will not be particularly impressed.
Trying to cling to office after an electoral defeat is not part of the job.
