If TFG took those documents after he left office, he was no longer POTUS and therefore is not immune. I wonder what Jack Smith is thinking.

(1,011 posts)He is telling Cannon to make the decision that the case is invalid due to this; Smith will appeal and it will go up to the Supreme Court. How do you think they will rule?

(1,011 posts)He gave implicit instructions to Cannon in his concurring opinion. It would not surprise me to see this court overturn one of its prior rulings.

(11,851 posts)makes much difference (except for BS motions trump's lawyers file using the initial confusion over it).
I guess Cannon will have to make a formal ruling, which will be a slow process for her and I suppose -- if she is fully in the tank for trump -- she could rule it's an "official act." That would surely be appealed.
None of these cases were going to trial before the election, anyway. We still need to beat trump at polls, and quit praying court proceedings somehow spare us.

(7,260 posts)I have no delusions about the courts. Given the ruling, I just wonder if Smiths team will shift gears. They will have to re-evaluate the J6 case. I just thought the documents case would percolate to the top if indeed TFGs crimes occurred after he left office. And some did.
