(32,349 posts)The fascists want us to give up, to lose hope, it is their plan, but dammit when a highly respected conservative judge says the J6 case is all but finished, it is very hard to overcome the feelings of dread.

(32,349 posts)As justice Katanya Brown Jackson wrote in her dissent, it will be up to the Supreme Court to decide what is official and what is unofficial. The SC gave itself the power to make TSF a king.

(520 posts)After you've been voted out of office, doesn't seem like an official act to me. Ignoring subpoenas from the justice department to return said documents doesn't sound like an official act either.

(23,718 posts)the case is not dead, it will be up to the court to decide if his actions qualify as official acts (and news flash, Chutkin is not going to call those official acts).
Luttig has had a lot of bad takes and isn't someone I'd listen to, honestly. He was on the whole "the 14th amendment is self enforcing and doesn't even need a ruling" bandwagon.

(32,349 posts)The SC spelled it out that prosecutors cannot use TSF's motive, intent to prove that his acts were unofficial. WTF is that, that's how prosecutors win cases by showing the perp's motive/intent.
