But my understanding is that the state department has not considered him illegally detained. Michael McFaul also made a side comment about that as well and he is a close friend of Fogel and he was not surprised he was not included in the swap. The media is now interviewing his sister and when asked about him not determined as illegally detained she did not directly answer that as well. There seems to be more to this, was he possibly a spy? He was a teacher for diplomats children for years in Russia, was there more to it? Doesn't mean they don't want to get him home but just that it is harder and the innocent are brought home first?
