One legal issue the episode raises is the so-called right of publicity, which protects peoples identities against exploitation.

The question arises after the GOP presidential nominee shared several images (some generated by artificial intelligence) on his social media platform suggesting that the singer and her fans support his campaign. One of the images portrayed Swifts likeness in Uncle Sam-style fashion, accompanied by the text: Taylor wants YOU to VOTE for DONALD TRUMP. The former president added: I accept!
Swift could sue. And while there are any number of reasons that the pop star wont expend the effort of taking Trump to court, one legal area that could be relevant is the right of publicity, which protects people from certain forms of unauthorized exploitation. That subject arose in another high-profile context recently, when OpenAI developed a chatbot voice assistant that sounded much like Scarlett Johansson; the company subsequently pulled it after public scrutiny, but denied that it was an imitation of the actors voice. (Representatives for Trumps campaign and Swift didnt immediately respond to NBC News request for comment.)
Trumps post comes as many legal questions remain unanswered in this era of AI proliferation and the internet. There isnt presently reason to think that this episode will become a legal case that tests those frontiers saying nothing of whatever would come of such a case, including any defenses (including on First Amendment grounds) that Trump would seek to raise. But if he continues to potentially antagonize the star, whose political sympathies seem to lie elsewhere, we may find out how much of a case she has.

It's very unlikely he created them, it isn't being used for commercial purposes and she is a public figure making a defamation case extremely difficult.

(3,246 posts)In court since he retweeted someone else's content. This writer (sorry I don't remember who) predicted she'd leave it alone, especially after what happened recently in Vienna.
I'm sure some would understand her staying out of politics for her safety or for the safety of her fans. But, if she says nothing and Trump wins, will that follow her? Of course, it will. And it should.
Lots of people are risking everything to defeat trump. I don't know where they get the courage but they show incredible courage openly standing up to a man who has said what he plans to do to those who oppose him. He's openly threatened prison or worse. Yet, people are standing up to him.
If you have influence, and you stay quiet, your silence won't be forgotten, right? Will anyone really see her the same? I think if we're being honest, we'd have to at least acknowledge that it won't go unnoticed. Some will forgive it and some won't.
I often think of the Bush family and am disgusted that Jeb and George are silent while a convicted felon is this close to gaining all the levers of power. They're not unaware. They're just cowards. Just like the Republican senators that voted against conviction after the Democrats had to add security to protect themselves and their families. And Speaker Pelosi' husband was attacked in their home. Republicans are cowards.
How is her silence not cowardly?
I hope she speaks out and joins the fight. Her sphere of influence is unmatched.
What's the saying? With great power comes great responsibility ( or something like that)

(1,461 posts)that the orange turd is now using. It would be the height of hypocrisy for the bush brothers to condemn the orange turd for using their Florida 2000 election theft road map. They're all rotten peas in the same rotten pod.

(3,246 posts)Jeb had aspirations of being President at one time. Conceivably, there are others in that family who'd like to give a run another try someday. There's no question they understand the significance of this moment. Their silence either points to cowardice or fear that trump might expose all their secrets.

(1,461 posts)They knew exactly what they were doing when they created the Presidential election theft road map in 2000. They had no interest or concern for democracy in 2000. Their silence now tells me that they still have no interest or concern for democracy now. What they did in 2000 has made the orange turd possible.

(32,324 posts)that supposed al-Qaeda person who got caught before he bombed her concert most likely convinced Taylor not to endorse Kamala.
I believe both her and Beyonce would have loved to perform at the DNC convention but the death threats are not worth it.
Say what you want about TSF but a lot of the time he gets what he wants by using mob tactics.
TSF fears Taylor Swift because she would lead a movement of young voters to the polls. If Taylor and Beyonce had performed at the convention and endorsed Kamala it would be all over for TSF.

(1,461 posts)I think she'll act when the time is right in 2024. I also think she has every right to sue the orange turd for making a blatantly false claim and for using artificial intelligence to spread the false claim.
