(1,783 posts)If he had, Smith couldn't have brought this before a grand jury again. All the charges would have had to be dropped against him.
What Trump got was immunity for official duties, which presidents already had, and some limited immunity for criminal acts, if the SC said any particular thing was part of presidential duties. That's why Smith removed some things from the charges and got another grand jury to indict again.

(53,191 posts)The ruling, strangely enough, just reinforced the status quo: presidents have total immunity for their official acts and none at all for unofficial ones.
There is absolutely no way in hell that sending a mob to attack the Capitol during the vote certification meeting because you don't like the results of the election could ever qualify as an official act. It does, however, run afoul of 18 USC 2381: Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States.
