I'm afraid I have to be the bearer of some very bad news about The Magistrate

We have received word from the family of The Magistrate that he has had a sudden and devastating heart attack. I've been asked to post the following on behalf of his family:

The Magistrate has had his last heart attack.

This week, days after seeing his cardiologist (who gave him a clean bill of health), The Magistrate had a severe heart attack that doctors say would result in permanent brain damage. He is totally unresponsive and will not survive. Tomorrow doctors will remove him from the respirator. Our extended family will be there along with friends.

DUers have been so generous in the past with their tributes and best wishes that the family would love to read the replies at the funeral. Please post your condolences and memories of James, aka Papa, aka The Magistrate, a kind, caring, funny, very very smart and loyal man who was considered very special by everyone who knew him. We will miss him forever.

The Magistrate has been a fixture on Democratic Underground for nearly 23 years, almost since the beginning. He joined in October of 2001, less than a year after the site was founded, and his sardonic wit and playful, unique posting style quickly made him a favorite of many DUers -- and occasionally drew the ire of others.

But as much as he sometimes raised the hackles of the folks with whom he loved to verbally joust -- and he wouldn't have had it any other way -- nobody could ever claim that The Magistrate did not care about this country and its future.

Sir, you were a great Democrat, and a great DUer, and you will be greatly missed.

This is what terrifies me about going to my cardiologist. My mother had a stress test, and then got a clean bill of health the day before she dropped dead of a heart attack in front of me. It happens more than people realize. A good reason to always tell your people you love them.

That Friday, she flew back to Detroit to oversee settling her mother in the nursing home they had chosen. She woke up the next morning, told her son, with whom she was staying while everything was settled, that she wasn't feeling well. Twenty minutes later, she was dead from a massive coronary. She was slender, non-smoker, casual drinker, upbeat, grrat sense of humour. No indications or markers at all.

I feel especially devastated that there were no obvious signs that might have forewarned his cardiologist, and somehow led to the prevention of this horrible outcome. That only makes the news more heart-wrenching--even while I know it happens-- no matter how good the care.

As a fellow member here from the beginning with The Magistrate, I can echo those who reference his intelligence, eloquence, broad understanding of issues, and curiosity for those he was learning anew. His posts could always be identified immediately by his preferred use of "sir" in each and every one. I worked closely with The Magistrate when I joined him in moderating the Israeli/Palestinian Forum at Jack Rabbit's retirement. The I/P forum at the time was unlike any other forum and prone to intense and personal flame wars between the various members. The topics and nuances of the situation required not only expertise but also the patience of Job. James was all of that and more. He was always fair, and no matter how heated the thread was, even if it was personally directed, he maintained a high standard and a sense of decorum.

Like me, he was a long-time student of military history and was very familiar with the many conflicts in the world over time. His passion for aircraft modeling was well-regarded by those in the hobby industry. We had many wonderful conversations about history and living in the 1970s. We talked about our personal lives and grew as friends. He always was a gentleman and a scholar. I am sad I never had the opportunity to meet him in person.

He and I used to quote an old military expression from the Philippine-American wars around 1900 about officers who served on the island of Samar during the fiercest of the campaigns. The allusion refers to the I/P forum.

Please stand for my friend James, "He served on Samar." Pass the bottle saved as a tontine and drink slowly and deeply to a gentleman, scholar, and true bohemian in life. May his memory serve as a blessing.

With his Confucian sig-line and playful-formal Confucian persona — he brought out a joyful Taoist in me, and I’m not usually a happy person when it comes to politics.

The Magistrate lost a lot of his lightness when his son passed away, but was still our sage with the formal air.

He was one of the earliest posters I remember engaging with regularly, and I was always secretly quite chuffed when he posted an accolade in response to one of my posts. His breadth of knowledge and the depth of thought and analysis he brought to many discussions truly enriched the quality of interaction here.

I am not surprised to learn his real-world family and community knew him as a "kind, caring, funny, very very smart and loyal man who was considered very special by everyone who knew him". He was all that and more, here, and I will miss him greatly.

The Magistrate (or James, as he’s now been revealed to us) has been a DU stalwart for almost 23 years. He’s always been a part of my DU, since I joined the group three months after he. What a force he has been within this community!

His prose was impeccable, his passion and intellect formidable in equal measure, his sly sense of humor devious and occasionally devastating. He certainly kept us on our toes by setting a consistently high bar for those of us who strive to think and write as well as he did.

I would be lying if I said I always agreed with him — and I know he would not want any of us to pretend otherwise — but I can honestly say that his arguments were always bolstered with a deep knowledge of history and culture, thoughtfully reasoned, and quite artfully expressed. No one could accuse him of anything less than 100 percent loyalty to the Democratic Party and the profoundly human values it represents.

I had very few direct interactions with him, although I always read his posts, because I considered him one of the DU members whose ideas and opinions were consequential. As much as it pains me to admit it, he caused me to change my mind a few times, or at least to soften some of my perspectives.

I remember when The Magistrate reported that he’d be away for a while after his son unexpectedly keeled over dead. The father of two myself, I have some sense of the anguish that such a loss brings — although only the parent who’s lost a beloved child can truly know that kind of grief. And now James’s family has to find the strength to bear another unbearable loss.

I hope his family and friends will find some solace in knowing that he had much love and respect from this cantankerous community of unlikely allies, and his influence will long linger.

I was lucky to meet The Magistrate a few times. He was not what I expected, but the minute he walked into the restaurant we all knew it was him.

Though I never knew his educational level, The Magistrate has to be one of the most widely read people I've ever known. There was nothing that he could not -- or would not --discuss with great intelligence. I served with him as a moderator years ago. He was a big help to me in learning the ins and outs.

The Magistrate definitely falls under the category of “irreplaceable people,” and I daresay it will be some time, maybe an eternity or two, before he is replaced.

Sly, erudite, eloquent, interminably patient, and courteous to a point bordering on chivalry. I have had the privilege of having one real life friend like that, and he suffered the ironic fate of being portrayed in a famous film as everything he was not. The Magistrate, at least in our tiny-yet-vast DU microcosm, will need suffer no such fate. The accolades for this irreplaceable (mes excuses, monsieur Premier Ministre) DU icon are deservedly universal.

I can only wave to a grand ship that has sailed for the last time. Shalom, salaam, sai jien, and above all, fair winds.

almost immediately became familiar with the Magistrate's posts and began to look for them whenever I logged on. He was a kind of DU map for me the first few months I was on here. He was often able to effectively communicate what many of us were thinking and feeling, but didn't always know how to put into words. He's such a foundational fixture here that it's hard to imagine DU without him.
His love and concern for the country, and his desire to keep working to help it live up to its founding principles, was always inspirational. Especially during more discouraging times when it seemed that nothing would ever change and we wondered what was the point in continued efforts and work.

I am so very, deeply sorry to hear of his passing and I hope it brings the family at least some comfort to know his positive impact here and how much he meant to all of us!

The Magistrate

It is through The Magistrate that I know James, for The Magistrate is his persona, the narrator of this particular story told through DU about the moral and ethical state that we, as a nation, have found ourselves in for the past twenty years.

So what exactly is a magistrate? A magistrate is an official who hears cases, delivers rulings, and issues warnings. Because the office is established to serve the best interest of the community at large, it is one of great responsibility.

When the job is done well, a magistrate earns respect and establishes trust, not so much through detached objectivity, but through his understanding of our common and connected humanity, informed by a considered perspective and a upright moral compass grounded in decency and compassion.

James’s Magistrate is the best kind of magistrate, an exemplar of the better angels, a magistrate who speaks deep truth in a deliberate and measured voice with the certainty of the righteous.

I am always inwardly proud and somewhat relieved when I find myself on the same side of an issue as The Magistrate, such is the esteem and respect that I hold for the ethics of his perspective. I have always been “m’am” and never the rare dreaded and devastating “dear”, a single word that cut so deep and clean that the recipient was left to wonder, “Why am I bleeding?”

I had my one and only personal contact with James the man only last week when I thought I might have offended him with a response that was made to him, simply because it was the safest place to put it. The topic involved a problematic four-word phrase in a long speech. It was a close reader’s concern, so I knew he would understand.

James’s response was gentle and friendly. He pointed me in the direction of a Mark Twain essay that he said was the best and funniest writing advice that he had ever read. He thanked me for my kind words and exhorted me to be well and stay healthy.

I will not speak of The Magistrate in the past tense. That narrator, the persona of the author himself, will live on in the same way that characters live on in literature. And as for James, decent, kind, funny, and brilliantly gifted, I choose to leave the verb unspoken.

It has been an honor.

I think I joined DU around the same time as The Magistrate--give or take a few days. The Magistrate was the first DU'er who caught my attention with that strong wit and his well-versed insight on issues that I was just learning about. He once corrected me on an issue that I was confused about and while he was very respectful and kind explaining this issue to me, I couldn't help but feel like I was sitting in the principals office. He had such a command of language and insight that I found myself looking to him for clarity on things as well as reassurance.

Those early days here at DU were wrought with fear, anger and sadness, because the Supreme Court had just handed the election to Bush. I can remember so much hand-wringing ( from most of us) and uncertainty at that time (who knew Bush would look good compared to you-know-who), but The Magistrate always seemed to know what to say to get a laugh out of us and calm our fears.

There's just not enough words to say all the things I want to say right now, so I'll just end with, "Sir, it was an honor to 'know' you here at DU and to fight in the trenches together."

Yes I'm boasting.

Like Blue Roses, James was enraged over the 2000 election results. I said something like Why don't you find a site where you can say what you think? Here's one you might like.

I am not The Magistrate's wife. I'm a very lucky member of his extended family. He equally divided how much time he would spend with his wife or me, and everything was fair. We were together almost 30 years. He and Mary, who met in high school, were together 57 years. Lithos will be posting the obituary that will appear in tomorrow's Chicago Trib, and he might post some photos.

The word "brilliant" pops up in a lot of posts. I counted on his brilliance to help me understand stuff that long Covid has made hard to comprehend.

That's all I can say right now. He's all over my apartment and I cry in every room.
