Seems like a no brainer given there is no precedent making such a huge concession.
And if the orange idiot wins can he just do whatever he wants?
I know it's unlikely but why then delay the sentence.

The election interference/hush money case was brought by State of New York, not the DOJ.

That would be NY County District Attorney Alvin Brag's office. But the trial judge has a great deal of discretion in scheduling cases. There really are no grounds for appeal.

The DOJ is a federal justice agency - it has no juristiction over New York courts.
