"four counts of involuntary manslaughter, two counts of second-degree murder"

This is in reference to the charges against the father of the Georgia school shooting. Does anyone know why 2 would be manslaughter and 2 would be second-degree murder?"

This is from a CNN report: https://www.cnn.com/2024/09/07/us/apalachee-school-shooting-georgia-saturday/index.html

Apologies to those who think I should research this on Google instead of cluttering up DU with such questions. (Reference to other threads from today).

the two second degree murder charges against the father were for the murders of the two children, 'because of other laws' about crimes against children. I still don't understand it in detail, and didn't save the link, unfortunately.

I don't think we know yet. From The Washington Post

The counts against Colin Gray — which include second-degree murder — are the most severe ever filed against the parent of an alleged school shooter, and the speed at which they were leveled — less than 36 hours after the last shot was fired — is without precedent.

Georgia officials have provided little detail about what led them to target Gray, beyond alleging that he “knowingly” allowed his son, Colt, to access the AR-15-style rifle that investigators say the teen used in his attack. A year ago, local police interviewed both of them about alleged online threats the teen had made to shoot up a school, accusations that Colt denied at the time. Gray told the investigators that he had “hunting guns” but that his son didn’t have “unsupervised access” to them.

But I think the 2nd degree murder charges are a stretch.

It's the manslaughter charges that will stick.

Eta - my guess.

but perhaps it is strategic over-reaching for the sake of plea-bargaining on lessor charges.

Two were killed immediately. Two did not die immediately. I saw a headline that students of one of the teachers used their Tshirt to try to stop bleeding.

https://law.justia.com/codes/georgia/2022/title-16/chapter-5/article-1/section-16-5-1/

A person commits the offense of murder in the second degree when, in the commission of cruelty to children in the second degree, he or she causes the death of another human being irrespective of malice.

Two of the victims were minors and two weren't.

implement more mental health services and screenings when we don't have enough psychiatrists and psychologists available to provide those screenings.

My son's psychiatrist just stopped accepting Georgia Medicaid. Thankfully, they still accept Medicare, which he was switched to this year.

which stated that the two charges for second degree murder against the father are for the two children who were murdered, but not the adults, because of other laws having to do with crimes against children----

Sorry I can't provide a more detailed explanation nor the source--- it was a story on a phone app, but I use a desktop for my web posting...
