Texas Sues For Access to Medical Records of Women Who Receive Abortions in Other States

Disgraced Texas Attorney General Ken Paxton has sued the Biden Administration to block a rule that protects the medical privacy of women who seek abortions in states where the procedure is legal.

The rule is intended to safely allow women from red states access to reproductive healthcare in a different state in the wake of the Dobbs v. Jackson Supreme Court decision which overturned Roe v. Wade in 2022.

Paxton released a statement claiming the Biden Administration rule is a "backdoor attempt" to interfere with the ability of states to conduct criminal investigations. All medical records are protected under the Health Insurance Portability and Accountability Act (HIPAA), but law enforcement agencies typically have the ability to subpoena medical records for criminal investigations.

Texas has already sought to subpoena medical records for patients who received gender affirming care in other states, but Seattle Children's Hospital, and a Georgia Telehealth clinic called QueerMed sued to prevent Texas accessing those records.

beyond Texas, with regard to voter intimidation, SUPPRESSION, and persecution (including his 2020 suit to overturn votes from 4 other states), with regard to the Latino vote in Texas, with regard to intimidation and threats to women seeking control over their own bodies and their doctors,

the actions of DeSantis in Florida,

and Trump's threats of political violence, the rounding up of immigrants, and the prosecution of political enemies

are ALL things FASCISTS do, straight out of a Nazi playbook. And we can expect FAR worse if these psychopaths are ever allowed to seize control.

But what crime are they claiming to be investigating? If Jill Smith goes to New Mexico and has an abortion, it's legal in NM. Even if it was a crime in NM, under what context would they be investigating as the crime was committed in NM, not Texas.
I'm just so confused how this is a thing.

State governments have the right to make laws about what's legal in their own state. Trying to prosecute Texas residents for doing something in another state that is perfectly legal there seems like a hell of an overreach. I don't understand why they think they have the right to do that.

I think it was Washington state. He didn’t get his way then. He’s not going to give up. He’s already wasted so much Texas taxpayers money on his other attempts over the last election. All he wants is a chance at being the U.S. A.G. Under tfg.

How he stays on as attorney general is beyond me. Along with Abbott and Cruz, he has managed to turn Texas a bastion of insufferable ignorance….as DeSantis has done here in Florida. This right wing crap has to end.

We here in the ☀️ Sunshine State have a governor that wants to turn those pesky state parks into golf resorts! Abortion outlawed after 6 weeks isn't as on the level of going nationwide tracking down Texas women who behave like they have some say in what happens to them, but we're ahead in book banning and arguably voter suppression. And, and our governor looks like Alfred E. Newman.

Section 218 stated that "a woman who kills her fetus or permits such a killing by another will be punished by a prison sentence and, in especially serious cases, by penitentiary. An attempt is punishable. Whoever else kills the fetus of a pregnant woman will be punished by a penitentiary sentence, in milder cases by prison. If the perpetrator through such deeds continuously impairs the vitality of the German nation, the death penalty is imposed. Whoever procures for the pregnant woman a means or objects for killing the fetus will be punished by prison sentence, and in especially serious cases, by penitentiary"

CORRECTION: THIS IS FROM THE NAZI EUGENICS LAWS SECTION 218. THIS IS NOT A TEXAS LAW. I'M SORRY, I GOT THE TWO MIXED UP.

Like every state without a draconian abortion ban should make a law like that, just to send a message to Abbott and other thugs like him.
