3. Yes, you can sue (anyone can sue for anything). And in some states there are laws that would keep it from being tossed

out of court for failure to state a claim upon which relief can be granted. Right of publicity/persona is a state right - and not all recognize it. In 14 states, there is no law prohibiting it - so suing in those states would get the claim tossed. In the other 36 states there is a lot of variation in the details of the law.
