He has to have that removed in order to take office.

Al Gore (2001) all had to certify the electoral votes from a Presidential election in which they, personally, were the losing party. There's video on YouTube of Nixon doing this -- in it, he specifically mentions that certifying the results is his duty, no matter who the winner was.
