Clarence Thomas will have the final say on Jack Smith's report.

If the 11th Circuit overturns Cannon Trump can make an emergency appeal to the SCOTUS and Thomas can issue a stay unilaterally.

Smith's report will never see the light of day.

The President has unlimited power to declassify documents. That was a central issue in the Florida Trump case. Nobody questioned that Trump COULD HAVE declassified documents, but that still didn't give Trump the right to steal the original documents, which were still the property of the archives under the Presidential Records Act.

But Trump COULD HAVE declassified any document -- no evidence he ever did -- and then provide a copy, or citations, or whatever to any channel he wanted to.

In Trump's case, he wanted to trade them for money and power, so there was no way he would declassify them. They would no longer have any trading value.

Biden's situation is the opposite. He can simply declassify and publish any document he chooses.

But he won't. We need to ask ourselves and our Party how we got to this point where in the face of an existential threat to our very democracy, even then we still can't get a President to use his powers in what amounts to a very minimal way. When Democrats won't use the powers the voters give them, why should voters continue to give them power?

I mean, we could be asking Biden to declare the election void because of the 14th Amendment. But we are not. All we are asking him to do is release the findings of the Special Counsel, and evidently even that is too much to ask.

and who knows where it leaked from.

Better yet, tell Trump and his bootlickers to fuck off and deliberately release the report and its evidence for the better interest of the country. Let them squirm.
