Is there any legal mechanism to stop his overreach, such as an injunction?
And who would have standing to go to Court, an individual citizen, an organization?
A TRO (an immediate injunction called a Temporary Restraining Order) could be attained this morning.
Ideally, I would like to see Trump try to stop a federal marshal from locking the doors on Musk.
Think. Again.

(11,142 posts)Sure. They are already guilty of breaking several laws. But, since they do not care what we think, and since no one is willing to enforce them...?
In the immortal words of Jim Malone: "Now, what are you prepared to do?"
I also like the line that Elliot Ness says to the D.A.: "I have foresworn myself. I have broken every law I have sworn to uphold, I have become what I beheld and I am content that I have done right!"
That is pretty much the only option I see now. Because, despite some people's refusal to be realistic, there are laws and there is what is good and proper. Sometimes they clash. We seldom want to admit this, but it is the case. In the fight for our nation, we need to remember these words. Because they are not going to be 'legal' in their actions. Hell they are already guilty of crimes. Yet, we are wringing our hands and wondering if we can pass a law to stop this. Legislation is not going to stop this. Nothing short of an equal response is going to stop this.
There is no safety on the 'high road'. Time to get our hands dirty.

(603 posts)It's tough to admit but yes, extra constitutional means may be needed. Our politicians must act.
Escape
(469 posts)unlimited authority to run the government any way he chooses, without restriction. Musk, and all the other Trump criminals know they will be pardoned for each and every offense they commit.
Impeachment and removal from office is our only option.

(54,904 posts)I'm talking about a court enjoining/stopping Musk from dismantling the federal government. That's it.
Escape
(469 posts)if a court orders Musk to stop and he doesn't. Then what? He is above the law now.

(9,993 posts)What makes you think it could be attained this morning? There have been dozens of lawsuits filed against the administration already and multiple TROs put in place. However, those are usually not immediate, it takes a while for the judge to consider the merits before they grant the TRO.
I actually agree that a TRO against Musk should be attainable, but what isn't clear is what specific suit or charges need to be filed in order to get one?
