Arrest Musk

If Musk is behind the theft of $80 million dollars in federal money from New York City he might have committed a crime in the State of New York and so could be susceptible to arrest by state authorities. I have not seen anything new on this story since yesterday. I wonder if the New York State Attorney General (Letitia James) is going to do anything about it? News reports from yesterday said she was investigating. Musk must be stopped somehow. This might be a path towards doing that. State charges can not be blocked by the Feds and Trump could not pardon Musk if he were found guilty of a crime in New York State.

Should answer to a prosecutor. If that money had been transferred for a legitimate purpose ( which it was), reversing a wire transfer requires you show cause that you believe it was fraudulent in the first place.

It’s not legal to do that without a valid reason. I believe those funds were voted on by Congress or something to that effect. I don’t think it can be reversed by individuals.

For instance, some shady contractors scammed my father a long time ago while I was asleep. I will leave out the details, but part of what happened was he had written a check for them for a large amount. I called the bank and they stopped payment on it because it was fraudulent.

The clawback occurred one day after Elon Musk targeted the FEMA funds in a post on X, inciting a Republican uproar over the use of federal dollars to shelter migrants and prompting the Trump administration to fire four FEMA officials involved in the transfer.

Are you saying that you are 100% sure the DOGE directed, etc.?

If that is the case, what in the world does this mean: "4. FEMA reversed the wire transfer. You thought Musk did it?" It's hard for me to take any meaning from that other than an assertion that Musk didn't do it.

If you're claiming that I'm 100% sure, then you are quite the mind reader.

You are saying, if we add up all the bits and pieces, that Musk didn't do it, he just ordered it done.

I have a recollection of some words being bandied about here along the lines of "distinction without a difference."

And, frankly, it's hard for us lesser mortals to sort out how "has no authority" squares with "they tell the Dep't heads what to do."

I think on that one, you're just playing label games. They have no official authority. But they do have de facto authority.

Or is your current position in these shifting sands that DOGE told Noem and Noem did it and, Q.E.D., Elon is clean as the tooth on a Rhodesian Ridgeback? Because it was, like, DOGE, dude! And you can't blame Elon for that!!

Would AG James have any jurisdiction? The funds were earmarked for NYC from what I understand. It didn’t seem far-fetched to me that the legal no-nothings Trump and Musk could have thought Adams was in charge of those funds and made a deal with him to allow their theft in exchange for dropping charges against him. It’s possible James could be able to press charges. Knowing that Trump is virtually untouchable, I’d be plenty happy if she arrested Musk. I wouldn’t even complain if she arranged a plea whereby charges against him were mitigated if he explained what he’d done for Trump in 2024!

FEMA transferred the $$ to the NYC account... and then reversed the wire transfer.

That's all... no conspiracy, no armored truck heist.

The question is- Is it legal for the Feds to do that? Also who had control of the mechanism that reversed the payment? Was it one of Musk's DOGE Agents? I am not a lawyer, but news reports yesterday said Letitia James was looking into it. It does not seem to be business as usual.

Judge two allowed the payment to be rescinded (fact).

Musks only role was to point out the payment.

Hopefully someone corrects me if I’m wrong, but I’ve been following this pretty closely.

I think that your suspicions are legit. It seems clear to me that Musk is calling the shots here and his DOGE gang are executing his orders. Kristi Noem is a dummy. I think at most she was directed by Musk. I would be very surprised if Musk and DOGE were not involved, and as the prime movers. I suspect but I do not know. That is what an investigation is for. There might be a New York state crime here. If there is, I am confident that Letitia James and her team will be on it.

I follow the news like most people here. The fact is that there a 24/7 fire hose torrent of information and it is impossible to see everything and know everything. We do our best and try to verify with reliable sources. Few people are going to bat a thousand and know every fact in the crazy 24 hour news cycle. It is part of their strategy- overwhelm people with too much information. "Flooding the zone". We do what we can to keep up.

I’ve tried to kinda stay out of it. There has been a lot of disinformation out there. And when I see it panicking people, I’m torn. I pains me to see people getting really emotional over something that just isn’t correct. But I also don’t like conflict. But at what point does your obligation to those that seemingly are on the verge of making terrible life decisions override that? I just don’t know. All I know is I’m done for the evening. I think the flu is finally winning the battle with my immune system.

There's a difference between a general EO that says "We Will Root Out All The Fraud," and specific actions taken, at least taking your word for it, pursuant to that EO.

Some of us follow the news closely enough to know the difference.

Some of us, obviously, do not. Or cannot.

I don't know about anybody else, but I pulled all the money I could out of TreasuryDirect, and I'm going to my credit union tomorrow to ask if there's any way I can lock and unlock my accounts for outside transfers the way I can my credit card.

via online banking as needed. And so the bulk of the money did not stay in the account into which Soc Sec. was direct deposited.

We also contacted the credit bureaus and froze our credit reports. If you need them unfrozen, say for a mortgage application, that can be done, when needed.

I frankly don't know who has jurisdiction here, it's Federal money but it was given to a State. It might be very difficult to prove that Musk stole the money, as he doubtless had one of his goons do it and can claim ignorance. Sure, everybody knows it was his order, but you can't indict someone on what "everybody knows."

But that is what good Prosecutors and Investigators do- dig up the truth and the facts. I would be very surprised if Musk and DOGE were not behind this. This is just the sort of things DOGE has been doing and Musk has been crowing about. If a crime was committed in New York State, I am confident that Letitia James will be on the job. I am not a lawyer so I do not know for sure. But the NY AG will figure it out. I hope that there is something that they can do. Musk needs to be stopped somehow.
