New York Attorney General Letitia James has been referred for federal criminal prosecution for alleged mortgage fraud.
William Pulte, director of the Federal Housing Finance Agency (FHFA), wrote a letter obtained by CBS News New York to U.S. Attorney General Pam Bondi alleging that James "has, in multiple instances, falsified bank documents and property records to acquire government backed assistance and loans and more favorable loan terms."

Joint tenancy does not require an owner to live in the house.

(4,131 posts)and I have no idea if this is even an issue with the law.
I suspect they are just going to play with her, and it cost a lot of money to play like this.

(6,252 posts)find a juicy, non-existent non-sequitur to run with, and pretend it's critical to the nation's well-being.
Subsequent herds of idiots will rally to formation to protect this absurdity from the consequence of reality, followed shortly by rafts of sea-lions going on with a variation of the classic "it makes us look bad" opening followed immediately with the "she should have known better" gambit.
(the tricks are as old as speech, but given really hip labels in the here and now)

(4,131 posts). Specifically, it's alleged that in both 1983 and 2000, she submitted mortgage applications listing her father as a co-signer and misrepresented their relationship as "husband and wife." This misstatement is considered a legal issue because it could have been used to meet mortgage approval requirements.
These allegations are part of a broader federal investigation into James's mortgage activities, which includes claims of misrepresenting property details to obtain favorable loan terms. The investigation is currently under review by the U.S. Department of Justice.
As of now, Letitia James has not publicly responded to these specific allegations. The situation is ongoing, and further developments are expected as the investigation proceeds.

(28,612 posts)But the point here is that there's no chance that someone just stumbled upon this 25+ years later (when the mortgages have certainly been paid off and/or refinanced multiple times). Someone went digging for dirt on her specifically.
MichMan
(16,486 posts)It wasn't relevant to findings of fraud for misrepresentation on the loan application to obtain more favorable interest rates which was what he was found guilty of. IIRC, that the loans were paid off and the banks were not part of the suit was the basis for his defense. According to the prosecutor, that had no bearing on the specifics of their case.

Not an expert, but I'm guessing the Statute of Limitations clock doesn't start until the loan is paid off, not when it was originated.

This won't end well for the con artist either.

(1,568 posts)We all knew they were going to go after her but I believe she will survive this unless the fix is in. Trump doesn't really care but it's the ALLEGATION that is the thing. Remember him trying to get the President of Ukraine to ACCUSE Biden of something, anything?
Bondi should be disbarred for several actions she has already taken or alluded to.

Remember when JD Vance said Trump is not a vengeful guy? It was unbelievable at the time. Now, as he pursues revenge, its vastly worse.
Checking names off his enemies list, Trump is just getting started: Remember when JD Vance said Donald Trump is ânot a vengeful guy.â At the time, it was unbelievable. Now, as Trump targets his perceived foes, it's vastly worse.

Trumps interest in partisan vengeance against his perceived foes, however, continues to intensify. My MSNBC colleague Jordan Rubin explained:
A criminal referral sounds serious, but it doesnt force prosecutors to file charges against anyone. Still, New York Attorney General Letitia James could have reason to worry about a Trump administration officials push for her to face federal charges even if she didnt break the law.
Rubins piece adds, James, of course, leads the office that secured the massive civil fraud ruling against Trump and others last year (its on appeal).
The president, evidently, hasn't forgotten.
All of this comes on the heels of the president directing the Justice Department to go after Christopher Krebs, who led the Cybersecurity and Infrastructure Security Agency; which came on the heels of Trump pressing the Department of Homeland Security to investigate Miles Taylor, a former high-ranking DHS official......
But there are also plenty of stops on the Republicans Revenge Tour that have nothing to do with individual people. That broader list includes law firms (which hired lawyers he perceives as enemies), universities (which hired faculty he perceives as enemies), leading news organizations (which covered him in ways he disapproves of), and cultural institutions (which he believes failed to align themselves to his vision).
Axios recently noted, In the final days of the 2024 campaign, Axios identified a list of perceived adversaries who fit what Trump ominously described as the enemies from within. As president, he has taken steps to retaliate against virtually all of them.
That was a month ago. The problem is vastly worse now, and theres no reason to believe conditions will improve anytime soon.

(1,889 posts)Wouldnt that stop an investigation in its tracks because it started under false pretenses or do they have people in these agencies that illegally searched the paperwork and passed it on.
If everything is on the up and up and they are just harassing her (Felon is so good at going after people for anything and creating a firestorm of lies), it will cost her so much money and time.
So many people he has done this to have just given up because the amount of money they would have to spend to defend themselves is more than they can handle without losing everything.
Another law that needs to be updated - the person known for serial lawsuits should have a financial punishment at least 10x what he caused the defendant in civil cases and prohibited for 10 years from filing lawsuits and similar criminal cases that are deemed false should result in automatic disbarment of the prosecutors willing to move the case forward.
Dont think it will ever happen
