A federal judge on Tuesday ordered the Trump administration to not let a group of migrants being flown to South Sudan leave the custody of US immigration authorities after saying they appeared to have been deported in violation of a court order.
US district judge Brian Murphy in Boston during a hastily arranged virtual hearing said that while he was not going to order the airplane to turn around, that was an option the Department of Homeland Security could employ to comply with his order.
Murphy warned that officials could be held in criminal contempt if he found they violated his previous order barring the swift deportation of migrants to countries other than their own before they could raise any concerns that they might face torture or persecution there.
I have a strong indication that my preliminary injunction order has been violated, Murphy told Elianis Perez, a lawyer with the Department of Justice.

And I truly believe, with the speed at which they are all progressing, that in the near future, Trump will own the U.S. Military and use them, and ignore the Posse Comatatus Act....
THIS is it, MCE, we have to do something if we hope to salvage anything...

§ 91.3 Responsibility and authority of the pilot in command.
(a) The pilot in command of an aircraft is directly responsible for, and is the final authority as to, the operation of that aircraft.
(b) In an in-flight emergency requiring immediate action, the pilot in command may deviate from any rule of this part to the extent required to meet that emergency.
(c) Each pilot in command who deviates from a rule under paragraph (b) of this section shall, upon the request of the Administrator, send a written report of that deviation to the Administrator.

I want someone's ass thrown in jail and then we can worry about "could" and "may".

(1,256 posts)that would call the question. This is very deliberate, of course. They are clinging to the fiction that the judiciary is still a thing, and it isn't If they ever make a solid ruling against this administration, it will be ignored.
The judges (including SCOTUS) know it will be ignored, and they know that means the end of the Judicial branch of government for all practical purposes.
But it actually ended with the ruling giving Trump general immunity. That is the day the courts died. They just don't want to admit it, so we go on with this daily theater while judges act like they are making real decisions and the administration acts like it is obeying. But they all know it is over.
And when we report on and discuss this Kabuki theater as if we still had a functioning judicial system, we are aiding and abetting the destruction of our Constitutional system. We really must stop normalizing this.
P.S. The judiciary still functions to deal with street criminals, but little else.
