The Supreme Court will not hold. The system has

collapsed. What started with Dodds is nearing its completion. Absent an injunction remedy, each individual birthright citizen must hire their own lawyer to fight for their right to live in the place of their birth. The right is reserved for those who have the cash to hire counsel. And all the Alito originalism is just a smoke screen for the vilest racism with a helping of plutocracy.

We have blood witted bounty hunters searching for immigrants. I don’t believe ICE is performing routine background checks which is the normal standard of care for law enforcement hires. I wonder how many potential Golden State Serial Killer cops are now in the employ of iCE.
We have actual gulags now. We are disappearing humans.

The budget-Silicon Valley Billionaires are set to get richer and collect a huge pay day tax break with the impact of it being carried by the weary American worker.

Foreign policy- we are a Putin cheerleading squad while brave Ukraine tries to survive our choice.

You may criticize my despair but let this flow out. This is a day of mourning because I know that my supposed modern country is subjecting the helpless to so much pain. There will certainly be other days for battles and grim determination but today I heard on the wind a dying breath coming from the Capital.

Here we had almost 3% of the country for a No Kings protest, and SCOTUS says, hold my beer. I swear if rump says, the age of consent should be 3 years old, half the country would agree.

...anything you don't absolutely need. General Mills just announced decreased sales of 10% and predicts it will even become 15% less by next report. Kick big business in the wallet and folks in DC will be messaged by their donors that the direction is bad and getting worse. Bond market is already messaging and stock market will peak and start to backslide as the real estate market is already doing in many places.

I wake up already heart-broken every morning at this point.

The donald has caused more outrage, lies and falsehoods, and other verbal pestilence to be rained down upon this country. And so far, he's been able to operate with impunity, not facing ANY consequences or any legal opposition to curtail ANY of this shit. His attitude always seems to be "you can't touch me!" And I will never stop hoping that SOMEBODY, SOMEWHERE, finally can.

Unless voter trends suddenly shift and the ongoing migration from state to state changes, the reapportionment after the 2030 census is going to hurt us bad. The predicted maps show enough House seats, and therefor Electoral Votes, shifting to away from blue states to solid red and red leaning states that they won't even need to win a single "blue wall" state to win the Presidency.

So fucking what? Big wow. If they can't do these things for those of us here since 1619 then get the fuck out of our way.

Biden was amazing! But resetting us to January 2017 didn't work. The maggots did it again.

Wrote and said directly “No right is safe in the new legal regime the Court creates.”. So either she is not truthful (which I don’t believe) or the majority opinion is as bad as she thinks it is. That is a pretty direct statement. After Dodds and after all of the 6 justices testified to the settled law of Roe, my confidence that the Courts will hold is zero.

Trump has over 3 years to figure out how to destroy our election system. Make no mistake technology will be the handmaiden of darkness in accomplishing that.

With AI many people will no longer be able to discern truth from fiction. Journalists will no longer be able to trust any sources. In 3 years, the propaganda machine will completely control everything we read or hear and every single person in this country will be continuously monitored.

There is nothing in modern history that is even close to what we are going to experience. Even today every single aspect of your life is digitally collated and available for Trump and his Ministry of Truth to use to control you. It is a simple matter for today's AI to monitor and enslave a mere 350 million people.

Our Constitution failed to protect us from the USA becoming an authoritarian state as anyone who really thought about knew it would. It was just a matter of time for someone like Trump to pack the SCOTUS and set the stage for establishing a police state.

Life will go on. But it will go on without the American Dream. We should count ourselves lucky to have had 250 years before this happened.

I was born to US parents but I was born in a civilian Dutch hospital and I have a Dutch birth certificate and US State Dept issued naturalization papers.
I get it seems unlikely but the "unlikely" seems to be getting more and more likely every day.

Unfortunately we are witnessing a slide into authoritarianism all across the world. Sure there will be holdouts, places where freedom may survive for a few generations. But we are witnessing the change of the guard.

Not trying to be dramatic or depressing, but I truly believe that we are not far away from someone somewhere using nuclear weapons and triggering the holocaust that will send us back to the Stone Age. Would you rather be enslaved or be vaporized? One day soon we will be faced with that choice.

That's how I have my citizenship, I was born here. My parents have their citizenship too because they were born here.

I too think our Democracy has been ended. Trump now has the power to deport any American who opposes him.

300 Million Americans are now subject to ICE deporting them should the Trump administration decide to do so. No charges, no warrant, no trial. You and I can be disappeared to another country and thrown in prison if Trump says so.

It only impacts individuals born after a February 19, 2025, and only impacts certain people born to non-citizens after that date

It isn't retroactive, and it doesn't apply to children born to mothers who are citizens.

Mierda47 will issue an EO to cover every brown person with a lastname that sounds either Arab or Hispanic/Latino to prove Birth Right Citizenship.
They're already doing it now.
The ICEtopol is asking brown people right now, what their immigration status is.
You think they need a warrant? They don't need no stinking warrant.

I now have to carry my Passport Card with my drivers license to prove I'm a U.S. Citizen.
The only good part, is that I don't speak like my cousin Chuy from East El Ehh. (Spoken in a Spanish accent).

They have a goal of ~13,000,000 deportations, and they've only gotten about 10K
Our Emperor will issue an EO that will create a large window to allow more of us to fit into what they're looking for.

And God forbid we go into the wrong part of the country, where the district won't recognize my Birth Right.
I'll be a US citizen in some states and NOT a US citizen in others.

The executive order was very carefully crafted, by someone other than Trump, to have the best chance at success in the courts. It is strictly limited to individuals born 30 days after it started. It doesn't apply to all individuals born to non-citizens - just the classes they believe have the most tenuous ties to citizenship. They know they are on weak grounds, and took a lot of care to do something without overreaching.

No, they are not going to issue another, broader, birthright citizenship EO until this one has had some success. That will be at least a year.

As long as you are a citizen now, you will be a citizen in every state, unless you less than 5 months old. The executive order is very clear that it applies only to people born more than 30 days after the date of the order (Jan 20, 2025). And if you are less than 5 months old - congratulations on being an infant prodigy.


That doesn't mean that brown people can let down their guard. They are going to continue to push the limits of deportation - searching for catch and kill locations to bump numbers (ports of entry, court hearings, immigration status hearings, visas, etc.) They are going to continue stopping brown people, and "occasionally" scooping up citizens in their wake - and shipping to detention first, and asking questions later. Every deportation - even if it is just turning someone away at the port of entry adds to their count - and they want numbers they can shout to the world. It is abhorrent.

BUT I was addressing solely the legal impact of this decision, in the wake of a whole bunch of people who are not impacted by even the broadest interpretation of the court's ruling spreading disinformation about what the ruling itself means.

Your points are important but Sotomayor read her opinion and said and wrote this

The 14th Amendment plainly extends citizenship to “all persons born or naturalized in the United States,” she noted. “That means what it says.”
In failing to uphold that plain Constitutional pillar, she warned, “No right is safe in the new legal regime the Court creates.”

That impacted me. She apparently feels the majority is creating a new legal regime.

But the impact of this decision isn't directly on birthright citizenship - and to the extent it is on birthright citizenship, it is only about those born after February 19, 2025.

But, the birthright decision aside, this decision makes it exponentially harder to fight illegal and unconstitutional actions. Instead of suing in one (or a handful) of states, organizations defending our constitutional rights will need to file suit in every single state (possibly in every district - I haven't read it to see whether it is a state-by-state, or district-by-district issue). That multiplies the cost of fighting Trump by 50, at least.

I am not minimizing the impact of the actual decision of the court on fighting Trump. What I am trying to do is to cut off the wild, "We're all gonna be deported, since none of us are citizens" nonsense - since that was not the question before the court (not even the one before the court when this substantive question reaches the court - it will still only be about birthright citizenship for some individuals born after February 12, 2025).

My post was addressing the limitations in the EO (purportedly defining birthright citizenship), and the Supreme Court's decision. Citizenship is related to deportation - BUT none of the deportations so far,, that I'm aware of, are relying on the EO's interpretation of citizenship.

They are certainly deporting anyone brown they think they can get away with deporting. But they aren't deporting them because of the EO on citizenship (or because of the court decision today). The citizens they are deporting are children deported with their parents (often by tricking their parents), they are deporting citizens because of administrative screw ups. I haven't heard a single claim that they are deporting someone who isn't a citizen because of the EO. The only one that comes close is the Thomas one in another thread - but he wasn't born on US soil, and his citizenship was determined in 2016 (not after the EO on citizenship).

I go back to great-great=grandparents before finding someone who was naturalized (and I only assume that because their baptism paperwork is written in German).

And that this is the direction it's going in:

Start organizing to supply funds for legal assistance. That's what fighting back is.

Think that's too difficult? It's not easy, but I did it two decades ago--raised 70k for a legal library, recruited lawyers to help people do their papers, had regular meetings, met with the administrative division of the court system in NJ. Met one-on-one with people who didn't know where to go or what to do about their situation. Had a regular cable tv show discussing the topic.

I had a very smart partner in this endeavor. I did not do it all myself. We recruited a network of people all over the United States and our organization was national. All of our assistance was free, but we actively recruited donations to keep it going.

I can go to Titchfield, England or County Galway Ireland or Brittany in France or Jutland in Denmark or anyone of several Scandinavian countries.

Are these children eligible for CHIPS, Medicaid, SNAP benefits? Is our government going to deny these children the right to vote?

The right to vote - there it is.

Who pays for a complete overhaul of 50 states (and territories) process for recording and maintaining birth certificates? What about passports? Are these children now stateless?

How does this affect the 2030 census? Run roh Governor Hot Wheels - Texas could lose several House seats.

Absolutely there are parallels with this EO. Justice Sotomayor describes it as an “existential threat to the rule of law”. “No right is safe in the new legal regime the Court creates.”

I don't think there is any way back. We are already over the cliff and into free fall. Trump is going to crank up the machine that is bulldozing its way into the underpinnings of our Constitution.

Make no mistake the first amendment is going to be his next move. Freedom of the press, first. He will use AI to distort and de-legitimize every news organization. And then it's time to play the "enemies of the state" card.

..and we have three years of this shit to go. I'm watching less news and even less from the Independent content creators. I cant watch any with clips of trump as i cant get him out of my brain then. 'The Enemy from Within' is my go to right now. No clips of donold just lots and lots of swearing....which is where I'm at, at the moment.

Barrett is really just as much of a Trump stooge as the other stooges. Roberts doesn’t care about reputation anymore. That injunction ruling yesterday was just plain MAGA and not according to law.
