Inside a federal immigration courtroom in New York City last month, a judge took an exceedingly unusual step: declining to state the name of the Immigration and Customs Enforcement attorney pressing to deport asylum seekers.
Were not really doing names publicly, said Judge ShaSha Xu after stating her own name and those of the immigrants and their lawyers. It was the first of two separate instances The Intercept identified in which judges chose to withhold the identities of the attorneys representing the Trump administrations deportation regime.
As ICE agents across the country wear masks to raid workplaces and detain immigrants, government attorneys need not cover their faces to shield their identities. Legal experts who spoke to The Intercept agreed the practice of concealing the lawyers identities was both novel and concerning.
Ive never heard of someone in open court not being identified, said Elissa Steglich, a law professor and co-director of the Immigration Clinic at the University of Texas at Austin. Part of the courts ethical obligation is transparency, including clear identification of the parties. Not identifying an attorney for the government means if there are unethical or professional concerns regarding [the Department of Homeland Security], the individual cannot be held accountable. And it makes the judge appear partial to the government.

(9,150 posts)tell the judge I refuse to give my name. I would also be filing charges with any professional boards etc. regarding the judges and the government attorneys as John Doe cases if need be. This is only a step away from a judge taking motions and briefs from one side and not making them available to the other side. Secret pleadings by secret prosecutors are not far behind.

(12,380 posts)Ive told lawyers Im not super interested in doing this anymore. I hate not helping, but I also am far more comfortable giving written affidavits

So it's obvious that these lawyers fear they could be held accountable for doing something illegal or unethical if they are named as parties to such cases. Consciousness of guilt. How do bar associations treat this lack of transparency?

This is WRONG!!!!! No one should be allowed to be anonymous in a Courtroom. This practice invites abuse, and abrogates the Rights of the Accused.
Do we next excuse perjury if it supports a conviction?????
