(23,064 posts)If Schlump were to sue AOC for defamation because she called him a rapist, the outcome would depend in large part on whether not he is, in fact, a rapist. In order to defend the truth of her statement, she would have reason to dig into a lot of things that he would not want dug into, including the Epstein files.
He threatens to sue people all the time, for all sorts of things, and even files lawsuits he never actually pursues. It's his knee-jerk reaction any time someone says something he doesn't like. It sounds like his lawyers delivered a much needed reminder that filing such a lawsuit would involve shining a light on things he very much wants kept in the dark, and that realization brought him up short.

(23,064 posts)But here's the thing. If his lawsuit against AOC did go to court, the E. Jean Carroll case would be rehashed in court and in the media, drawing a ton of public attention to something I am sure he would NOT want people to be reminded of. And even dismissal of the case based on the E. Jean Carroll verdict would involve publicity that would focus attention on it. Either possibility would be embarrassing and infuriating for him.
So I suspect that that whether AOC's lawyers would need to access those files is a moot point. We don't know the exact words his lawyers said to him, but maybe by bringing up the Epstein files and reminding him of something he very much would like people to forget about, they reminded him of the folly of drawing public attention to another thing he very much would like people to forget about.

(4,958 posts)I don't think his reluctance to sue is based on the fact the case could be dismissed. He sued ABC into a settlement when Stephanopoulos said he was guilty of rape. He's clearly afraid of the discovery process, whether it's the Epstein Files or something else.

(10,783 posts)There were only 2 witnesses before Maxwell's grand jury. An FBI agent and a NYCPD Detective. Besides, the prosecutors would never present testimony before a grand jury that applied to anyone but the person they are seeking the indictment against.

(10,783 posts)The judge in the E Jean Carroll case said Trump was guilty of rape, so there is no defamation, libel, slander or whatever he thinks he can sue her for. This would get thrown out 1 second after it's filed.
