Mass. mom detained by ICE for 10 days over decades-old minor marijuana charge

Marcel Rosa watched helplessly as federal agents led his wife, Jemmy Jimenez Rosa, away at Boston Logan International Airport on Aug. 11. Their three young daughters clung to him in tears, fear and confusion.

What should have been the end of a joyful vacation to Mexico for the Canton family, with over 30 relatives, had turned into a nightmare. Jimenez Rosa, a legal permanent resident and mother of four U.S. citizens, was detained over what her lawyer believes was a decades-old, personal-use marijuana charge, which is no longer a crime in Massachusetts today.

“I was just like, ‘Girls, we might never see your mother again in this country,’” Marcel Rosa, 38, said on Friday.

“I looked over to the officer and said, ‘Am I telling the truth?’ And he said, ‘Yeah, that could be possible.’ I told my kids right in front of the officer that she’s being arrested, and the girls just started crying, hugging her,” he said.

“I know most parents would not have told that to their kids, but there was no way I was going to allow those officers to think they’re just going to rip my wife away from my family, thinking it’s going to be ‘business as usual.’”

certainly not for a charge that's decades old. That's one of the main reasons it should be legal everywhere in the country. Too many cops use the "I smell mariwawna" excuse to hassle people and haul them off. It's stupid and it should be a relic of the past.

'Asset forfeiture' is the name of the game. They rake in millions in the name of 'asset forfeiture' and they don't even have to keep tabs on it. Which is why, time and time again, when outside agencies want to find out about this, they get stonewalled and given the runaround.

Please remember, cannabis is the only drug that leaves a residue in one's system for thirty days... even more at times. Now, I am not talking about the 'effects' of cannabis... that usually lasts only four to eight hours depending on your metabolism. But, there will be trace elements and they can detect it. Of course, they don't have the means to reliably determine that you are under the effects of cannabis, but they can detect that trace in you even if you have not smoked any in weeks. They know this. They know that they can continue to seize people's belongings and finances because they got people to tweak the laws so that this trick of detecting trace elements as opposed to detecting actual impairment is seen as completely acceptable.

If they ever developed a device or compound that could detect whether or not one had consumed alcohol in the pasty month, and used that as the reason for asset seizures, how long do you think it would remain, especially once a few congress critters get arrested and charged with DUI because they had a drink three weeks ago? Imagine if they could develop a device that could detect cocaine in one's system for a month or more. Suffice to say, there would be major resistance to those things.

However, they do not want this one to change. Cannabis is the greatest income generator the police have ever had. They do NOT want to get rid of it.

an arrest, and they wouldn't be able to arrest people if it weren't for our regrettable laws regarding cannabis. A cop's olfactory nerve is stimulated and the next thing you know, they're tearing your car apart looking for something, anything to nail you with. They do seize assets sometimes, or they might fine you thousands of dollars, which amounts to the same thing. But first they need the pretext to go treasure hunting in your car.
