BREAKING: Judge Xinis issues order barring Trump administration from deporting Kilmar Abrego Garcia “until further order of the Court.”

The admin stated earlier that it would not deport him during this habeas consideration.

Also per today’s order, the habeas hearing is set for Oct. 6.

Here’s the order: https://storage.courtlistener.com/recap/gov.uscourts.mdd.589189/gov.uscourts.mdd.589189.20.0_2.pdf

about orders issued by lower courts?

He'll do it anyway. And then he'll get an order from a lower court (i.e. not the SCOTUS) to not do it again, or run the risk of another court order.

It's like when you finally think you understand anything about immigration law, you realize that you don't.

He just filed for asylum again. It was denied because he waited a over a year after arriving. He filed again because he arrived in the US again a few months ago. The reason is kinda strange, basically he is seeking asylum because "Trump is persecuting me". A sympathetic immigration judge might be buy it, so it's worth a shot. Immigration is quite subjective. I really don't feel he meets the criteria for asylum. That vehicle he was driving belonged to a major human trafficker. . That in and of itself would be enough to deny himself asylum. However, it's all subjective. It isn't like criminal court. They allow hearsay and guilt by association. I had relatives who were deported. "Likely to be a charge", "Trachoma". I guess not much has changed since the 1920's.
