SCOTUS once again just tosses out the Constitution without an explanation

#BREAKING: With no explanation (save for a solo concurrence by Justice Kavanaugh), #SCOTUS has frozen lower-court rulings that had enjoined allegedly suspicion-less arrests as part of "roving" immigration patrols in California.

Justice Sotomayor, joined by Justices Kagan and Jackson, dissents:

I can see the MAGA SCOTUS making a decision that states:

Any actions that a white male performs on behalf of his god-given rights to dominate all inferiors which, by definition include all non-white, non-male, non-xian, non-gun owners, shall be permitted without interference by any branch of this government - unitary executive excluded.

I guess this applies to citizens, who are now free to "discriminate" against certain groups, say...armed, masked fat men in unmarked cars that refuse to identify themselves"

Since Donnie Dipshit appears to be a fan of Apocalypse Now, I assume he understands the term "extreme prejudice"?

Democratic appointees in dissent said the move is “unconscionably irreconcilable with our Nation’s constitutional guarantees.”

https://www.msnbc.com/deadline-white-house/deadline-legal-blog/supreme-court-los-angeles-roving-patrols-emergency-relief-trump-rcna224611

The Supreme Court’s Republican-appointed majority has granted the Trump administration’s emergency request to lift an order that temporarily restrained the government’s “roving patrols” in Los Angeles. A California judge had ruled that plaintiffs who sued the government, including U.S. citizens, would likely succeed in their claim that officials are conducting such patrols without reasonable suspicion.

The high court’s three Democratic appointees dissented from the unexplained majority order Monday, with Justice Sonia Sotomayor writing for the trio that the Fourth Amendment’s historical protections from arbitrary government interference “may no longer be true for those who happen to look a certain way, speak a certain way, and appear to work a certain type of legitimate job that pays very little.” She called the majority’s move “unconscionably irreconcilable with our Nation’s constitutional guarantees.”.....

Opposing emergency high court relief, the plaintiffs countered that the judge’s order “broke no new legal ground,” writing that it “does not prevent the government from enforcing the immigration laws, conducting consensual encounters, or relying on any or all of the four factors along with other facts to form reasonable suspicion.”

They further wrote that the administration’s “extraordinary claim that it can get very close to justifying a seizure of any Latino person in the Central District [of California] because of the asserted number of Latino people there who are not legally present is anathema to the Constitution.”

17. The fucking Shadow Docket.
Mon Sep 8, 2025, 02:07 PM
Sep 2025

The Supreme Court's "shadow docket," or emergency docket, refers to cases where the court issues orders without full briefing, oral arguments, or written opinions, often in matters requiring immediate action like injunctions or stays. Coined by law professor William Baude in 2015, this process allows for expedited decisions on procedural or emergency matters and has recently been used for significant, high-profile issues, leading to concerns about transparency and a lack of detailed reasoning from the Court.

What It Is
Emergency Cases:
The shadow docket handles urgent requests for relief, such as injunctions and stays.
Expedited Procedure:
Cases are resolved quickly, sometimes within days of the application being filed, with limited briefing.

Lack of Transparency:
The Court often issues unsigned orders with little to no explanation for its decision, making it difficult to understand the justices' reasoning.
Contrast to Merits Docket:
Unlike the "merits docket," which involves full arguments and lengthy opinions, the shadow docket is a departure from ordinary Supreme Court procedures.

Why It's Used
Preventing Irreparable Harm:
The Court grants requests on the shadow docket when it believes an applicant will suffer irreparable harm if the request is not immediately addressed.
Addressing Procedural Matters:
The docket is used for various procedural issues, including scheduling and granting or denying requests to halt lower court orders.

Concerns and Significance
Public and Legal Attention:
The shadow docket has garnered increased attention from legislators, legal experts, and the public due to its implications for high-profile cases.

Potential for Abuse:
Critics argue the shadow docket can be used to make major policy changes with little public deliberation, leading to a lack of accountability.

Mon Sep 8, 2025, 02:54 PM
Sep 2025

Is there any way we can fight back now? I wonder if it would help if we communicate with the Supreme Court by postcard or telephone complaining about the majority's unconstitutional rulings.

I think we will get control over our rogue government in a few months because I firmly believe the vote was stolen. I know something about voting on computers and computer programming and I have been following election integrity issues for 21 years. As Elon Musk said at a town hall in Folsom, Pennsylvania on October 17 2024, “I’m a technologist. I know a lot about computers, and the last thing I would do is trust a computer program. Because it’s just too easy to hack. It’s too easy to add just one line.” There is a great deal of evidence of massive vote manipulation in the 2024 election (probably thanks to Elon) per ElectionTruthAlliace.org, but the proof will take a little time.
