Even if he produced his bank records, the absence of a deposit doesn't negate the receipt of cash which he has otherwise spent or converted.

Seeing him carry it away wouldn't prove that he didn't take it, of course.

It would demonstrate that he DID take it.

You're saying demand they show us the surveillance video and call their bluff when they won't because it must certainly confirm his guilt.

So, there was concern prosecution would be difficult.

It’s BS, but that’s the quess by attorneys with little interest in protecting trump admin.

Now, if he delivered the contracts after trump inaugurated, he should be toast after a few weeks of WH circling the wagons.

though he could be charged with conspiracy to commit bribery (in the future). The FBI was apparently waiting to see if he followed up on his promises to deliver contracts when Trump, or one of his minions, pulled the plug on the investigation. But another question even if no bribery or conspiracy charges could brought: Did he declare the $50,000 on his 2024 income tax return?

If Homan wants to prove his innocence do it through the DOJ and FBI who investigated him.

Waiting for Democrats to demand that the FBI and DOJ release the documents.

September 21:

‘Release the Tapes’: Lawmakers Demand Answers Over Alleged $50,000 Bribe of Trump Border Czar Tom Homan

“Who’s the illegal now, Tom Homan?” asked Rep. Alexandria Ocasio-Cortez (D-N.Y.).

(snip)

“Tom Homan should be fired immediately and charged,” said Rep. Bonnie Watson Coleman (D-N.J.). “Kash Patel should be suspended pending impeachment proceedings, and anyone who aided in this cover-up should be held accountable. Homan’s relationship with GEO Group, who own Delaney Hall in Newark, should be thoroughly investigated, and the facility closed pending that investigation. The amount of corruption in this administration is endless.”

Sen. Ed Markey (D-Mass.) had a similar reaction. “Corruption that’s stunning even for this administration,” Markey said. “Homan and anyone who knew and covered this up must resign.”

(snip)

Release the tapes—Americans deserve disclosure of evidence showing top DHS official Homan accepting a bag full of $50,000 in cash,” said Sen. Richard Blumenthal (D-Conn.). “We need to know why the investigation was dropped—all the facts and evidence.”

September 22:

Democrats demand answers on Homan bribery investigation

“Did Trump’s DOJ shut down this bribery investigation? Was it Attorney General Bondi or FBI Director Patel? The act was caught on camera. The administration must turn over the tapes to Congress,” Sen. Elizabeth Warren (D-Mass.) said Sunday in a post on the social platform X.

(snip)

“Border Czar Tom Homan was caught by the FBI accepting bribes – on camera – to deliver government contracts in exchange for $50,000 in cash. Pam Bondi knew. Kash Patel knew. Emil Bove knew,” Sen. Adam Schiff (D-Calif.) said Saturday in an X post.

“And they made the investigation go away. A corrupt attempt to conceal brazen graft,” the Golden State senator added.

(snip)

Michigan Sen. Elissa Slotkin (D) said Saturday on X that “we cannot become numb to this type of corruption.”

“This is a senior official in charge of stewarding taxpayer dollars. We need access to this FBI case file, and then review the taxpayer dollars that Tom Homan has overseen at the White House,” she added.
