(14,470 posts)Yet someone actually called the cops in Morristown TN because the Boy Scouts were ceremonially burning some old disreputable American flags. The cops told the caller off and said the Scouts were doing the right thing and had a permit to do it.

(43,094 posts)the owner is supposed to take it to an American Legion post, Boy Scout troop or other entity authorized to burn it "ceremoniously.".
How silly. I can burn it as well as they can, and even say a few words over it since ceremony seems to be their emtire point.
Let's see... "This was a good flag. It served its country well, just like the millons of other flags made in Taiwan sweat shops to represent the United States of America.
"I now commend this flag to a blaze of glory with this Bic lighter, also made in Taiwan, or China or some other country whose indentured servitude works to our advantage. USA!"

(55,075 posts)Texas v. Johnson, 491 U.S. 397 (1989), is a landmark decision by the Supreme Court of the United States in which the Court held, 54, that burning the flag of the United States was protected speech under the First Amendment to the U.S. Constitution, as doing so counts as symbolic speech and political speech.
Activist Gregory Lee Johnson was convicted for burning an American flag during a protest outside the 1984 Republican National Convention in Dallas, Texas, and was fined $2,000 and sentenced to one year in jail in accordance with Texas law. Justice William Brennan wrote for the five-justice majority that Johnson's flag burning was protected under freedom of speech, and therefore the state could not censor Johnson nor punish him for his actions.
The ruling invalidated laws against desecrating the American flag, which at the time were enforced in 48 of the 50 states. The ruling was unpopular with the general public and lawmakers, with President George H. W. Bush calling flag burning "dead wrong". The ruling was challenged by Congress, which passed the Flag Protection Act later that year, making flag desecration a federal crime. The law's constitutionality was contested before the Supreme Court, which again affirmed in United States v. Eichman (1990) that flag burning was a protected form of free speech and struck down the Flag Protection Act as violating the First Amendment. In the years following the ruling, Congress several times considered the Flag Desecration Amendment, which would have amended the U.S. Constitution to make flag burning illegal, but never passed it. The issue of flag burning remained controversial decades later, and it is still used as a form of protest.[2]
Time magazine described Texas v. Johnson as one of the best Supreme Court decisions since 1960,[3] with legal scholars since stating that "Freedom of speech applies to symbolic expression, such as displaying flags, burning flags, wearing armbands, burning crosses, and the like."[4]

RE: Prison Sentences for Flag Burners
DTG: 151200Z June 2026
Dear President Trump:
Please either rescind or amend your 2025 order that anyone caught burning a flag be sent to prison for a year.
It is traditional in the United States that Boy Scout, Girl Scout, Trail Life USA, American Heritage Girls, 4-H, Junior ROTC, Young Marines, and veterans' organizations conduct Retirement ceremonies for unserviceable United States flags. According to the United States Flag Code, Title 4 of the US Code, the retirement of an American flag is to be performed "preferably by burning."
On Memorial Day, your goon squads arrested so many little children and honorable veterans performing their patriotic duties that we had to let all the criminals out of jail so we could lock up ten-year-olds and Medal of Honor recipients.
This is inexcusable. Fix it NOW!

(43,094 posts)it's kind of ridiculous to burn a flag in protest when it's legal to do so. But if it were ever made illegal, burning one would be an apt protest. An executive order, though, does not automatically convey illegality, especially in a case like this that defies decades of Supreme Court decisions.
This would be a great test case with any other SCOTUS. I wouldn't trust this one to uphold precedence in something of a "monkey trial," though. Still, I wish I had the fortitude to face the consequences that might come from being the flag-burning defendant.
