This Term for SCOTUS
I can only hope that appellate attorneys will submit remarkable briefs to SCOTUS that are airtight, have scrutable arguments, and themes of protecting the Constitution, perhaps correcting past mistakes.
If not to discourage judicial activism by the Shameless Six, then to make them take pause.
(I know, I know, I know. The "benefit" of the subliminal messages will fall on the law clerks of the Justices. But the Justices can't ignore the policy arguments behind the cases.)
