without a declaration of war, can Trump be turned over to The Hague without consent by the Supreme Court?

4. US doesn't recognize ICC jurisdiction

And there is a law on the books that forbids local, state, and federal agencies, courts, and law enforcement from cooperation with the ICC, forbids extradition of US personnel, which includes elected officials, to the ICC, and authorizes the President to use any and all means to rescue US and allied personnel from ICC custody. Its called the Armed Service Members Protection act. Passed in 2002. Nicknamed the Invade the Hague act.
