workers.
When the owner demanded his payment, this bozo sent an email complaining about the work and threatened to call ICE.
There are some truly awful people.
If those are your "principles", why didn't ask for it before they started the job???
Makes me wonder how many others are being taken advantage of like this.

And yes, a lien would be awesome, as she has no grounds to stand on and would get her ass handed to her.
Until she appeals to whichever level of judicial review that has been corrupted by the orange gibbon and gets it all back, plus interest, because the contractor dared to have one immigrant on his crew, regardless of their legal status.
That contractor needs to go scorched earth. He won't, but he should.

TUCKER, Ga. A Tucker-based construction company says a local homeowner has refused to pay more than $30,000 for completed work, allegedly demanding to see the workers' green cards before releasing payment.
Mario Aguinada, owner of Sun Dry Waterproofing, told 11Alive that his company performed foundation and waterproofing work at a home in Tucker in July under a $31,000 contract.
Aguinada said he has not received any payment and is now thousands of dollars in debt due to unpaid bills.
"This has cost me a lot of money," Aguinada said. He said he paid $17,000 to $18,000 for the materials.

When they took him to court he engaged in his typical legal warfare until
they went bankrupt and out of business or caved in.

Everybody knew what he did, nobody did anything about him. Until I moved there, and learned about this disgusting excuse for a person. By the time I was done, his business was completely gone, and more than one relevant official shuddered when they heard my name. Cannot imagine why.

would a lawyer defend this person in court without explaining how badly they will lose?
$30k is more than the limit in small-claims, so unless this person chooses to go pro se, shell want a lawyer.

NJ allows for small claims cases in the amount of $3k or less. I have won several cases in small court. Collecting is tedious but I do end up getting the money.

(17,664 posts)There were several hispanic landscapers working right next door to me last week. I didn't have any need to hire a company for the small items I needed done and couldn't find anyone who would do such a small task. So I walked over there and asked two of them if they could do it for me after they were through working on the big job they were hired to do. They said they would come back at the end of their day which they did. I handed each of them a $50 bill. The work only took them about 15 minutes, but I was desperate to get this done before winter so I could plant something.

That homeowner is disgusting. She's harming honest homeowners who may now have to pay up front for similar work.
I'm also curious to know who the company owner (Mario Aguinado) voted for.

ask if all the employees have the legal right to work in the US - which is not the same thing as having a green card- before hiring the contractor If she was working with a contractor, they should be able to provide proof of insurance and worker's comp coverage as well. But IANAL

(7,814 posts)Most of the workers were Hispanic/Mexican. Work was done in a complete & timely manner. Cleanup; almost nothing was left behind. Were they undocumented? Don't know & don't care. They could teach us about a work ethic.
My opinion; if they have a problem with the work performed, I am inclined to think is because they have some sort of a twisted and scheming agenda.

The homeowner's response: The homeowner denies the contractor's claims and states that emails she sent were taken out of context.
Current legal action: The contractor has filed a lien against the homeowner's property in an attempt to get paid for the ($31,000) in work and materials.
Financial impact: The contractor is facing financial hardship, claiming to be in debt due to the non-payment.
