WTF? Supreme Court will consider whether people who regularly smoke pot can legally own guns

WASHINGTON (AP) — The Supreme Court said on Monday that it will consider whether people who regularly smoke marijuana can legally own guns, the latest firearm case to come before the court since its 2022 decision expanding gun rights.

President Donald Trump’s administration asked the justices to revive a case against a Texas man charged with a felony because he allegedly had a gun in his home and acknowledged being a regular pot user. The Justice Department appealed after a lower court largely struck down a law that bars people who use any illegal drugs from having guns.

The Republican administration favors Second Amendment rights, but government attorneys argued that this ban is a justifiable restriction.

They asked the court to reinstate a case against Ali Danial Hemani. His lawyers got the felony charge tossed out after the 5th U.S. Circuit Court of Appeals found that the blanket ban is unconstitutional under the Supreme Court’s expanded view of gun rights. The appellate judges found it could still be used against people accused of being high and armed at the same time, though.

This country is so wildly fucked up I can barely stand it.

Billioniares exist.
Healthcare cuts are in, Vaccinations and Cancer studies are out?
Gun laws are sacrosanct ... until they aren't for people the "in" group fears/dislikes?
Taxes for the wealthy are out and services to the poor and needy are out?
Alcohol is perfectly fine, but marijuana is not?

The future will not view this epoch of incredulity and vapid cult worship well at all.
All the money in the fucking world can't erase the shame we are piling on our collective head.

The FIRST step in this fascist administration in removing 2nd amendment rights.
Can’t have Americans able to protect themselves now, can we?

except at bars..and probably hunting ranches..and domestic violence cases, but we know GOP doesn’t count that last one as serious ‘violence.’

"Unlawful use" of MJ is ANY under Federal law.

f. Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance?
Warning: The use or possession of marijuana remains unlawful under Federal law regardless of whether it has been legalized or decriminalized for medicinal or recreational purposes in the state where you reside.

This is the question Hunter Biden was convicted for lying/checking the box on.

Piss test before purchase of a gun? What about purchasing ammo? I’ve known a lot of cops that smoke weed. And soldiers.

...if you hold a medical marijuana card, my understanding is that you cannot get a license to carry. Both are state databases. Recreational use is asked about on the forms, under penalty of perjury. Dispensaries scan driver's licenses, but I don't know where that info goes or whether it getscross-checked.

These policies certainly put blue states with stricter gun laws at a huge disadvantage.

This will not sit well with those 2nd Amendment supporters. Some I actually know, but will remain nameless to protect their privacy.

With states with Pot Laws legalizing use for recreation up to 1 ounce, I suspect many will resist any ruling from the US Supreme Court.

Of course this is practically unenforceable. We’ll have to see how it goes.
