After all, he is the Commander of all the armed forces.
Who would try him? The Joint Chiefs of Staff?
Or some sort of military tribunal?
Who would make the decision?
Just like the rest of the military, he took an oath to protect and defend the Constitution. If anybody else in the military fails that oath, they can be court-martialed.
It has never been done. There is no precedence.
The President of the United States is a civilian and is not a member of the Armed Forces. As such, the Uniform Code of Military Justice does not apply to him or her. There exists no legal authority for any civilian to be subject to a court-martial.
That said, it isn't as though a court (e.g., SCOTUS) has ever looked at the issue, but presumedly no...
But the thought of the military rising up to hold him accountable is certainly a fascinating one.
