DOJ fights court ruling it says is blocking efforts to reindict Comey
Federal prosecutors are appealing an order blocking access to the communications of a close associate of James Comey, saying the move was a strategic tool to obstruct their case against the former FBI director.
A federal judge on Monday temporarily blocked the Justice Department from accessing seized materials from Daniel Richman, exchanges prosecutors relied on in arguing Comey had authorized his friend to make disclosures to the media.
A different federal judge recently tossed the case against Comey, determining U.S. Attorney Lindsey Halligan was not properly appointed when she brought charges against the ex-FBI director that were resisted by her predecessor.
But in the Richman case, the government argued that blocking access to his emails has effectively enjoined the government from investigating and potentially prosecuting Comey.
