If Democrats win a majority of congressional elections, but Mike Johnson won't swear them in, then can voters from those districts go to court under the aegis of Writ of Mandamus to force him to swear them in? (Of course, he'd delay it; he'd lose his Speakership.)
A (writ of) mandamus is an order from a court to an inferior government official ordering the government official to properly fulfill their official duties or correct an abuse of discretion.

(12,479 posts)That is the longest serving congressperson. They swear in both new and old Repesentatives and after that the entire Congress votes for a speaker.

(112,986 posts)This is in January of 2027 and ALL in the House will be newly elected/reelected (or gone). So, Johnson has no power and would be highly unlikely to become speaker again.
