But, Amy Coney Barrett occasionally hears the ghost of Ruth Bader Ginsberg (on things not abortion) I think...

(130,572 posts)which means he is skeptical of the "administrative state"; he doesn't like the Chevron case, which instructs courts to give deference to administrative agencies. He has tended to go with the liberals on cases involving due process rights and law enforcement overreach, and has consistently sided with Native tribes in cases involving tribal sovereignty. On the other hand he sticks with the conservative position on religious matters, and favors constitutional originalism. So he's kind of a mixed bag, ideologically.

(130,572 posts)because they don't think administrative agencies like the EPA should regulate business operations relating to the environment (or most other things, for that matter). "The market" is supposed to control what businesses do, not the so-called heavy hand of government.

(85,179 posts)He has a habit of being wrong and disappointing too often. The one I don't get is Kavanaugh. His reasoning is bad and he should know better, but maybe he wants to avoid MAGAT wrath.
