Judicial panel dismisses challenge to Wisconsin congressional map

A three-judge panel in Wisconsin dismissed a challenge to the state’s congressional map on Tuesday, deciding that it lacks the authority to rule on the matter.

The judges, Julie Genovese of the Dane County Circuit Court, Emily Lonergan of the Outagamie County Circuit Court and Mark Sanders of the Milwaukee County Circuit Court, wrote in an 18-page ruling that the Wisconsin Supreme Court did not provide them with proper guidance in assigning them the case.

Given that fact, the judges concluded that they have “no authority to supersede decisions” of the state Supreme Court.

The lawsuit, filed by 11 Wisconsin residents last July, alleged that Wisconsin’s congressional map violated the separation-of-powers doctrine and resulted from “unlawful partisan gerrymandering.” The Wisconsin Supreme Court appointed the panel to the case in November.
