I will call it now.

Both the liberal and right wing justices are pushing back hard on Sauer's arguments.

It's going to go down in flames exactly like the tariffs decision. We may get a 7-2 , i am hoping for a 9-0 but Thomas and Alito are brain dead magats and will probably dissent.

I think Thomas thinks it only applies to foundational Black Americans. So on that? You are bang on.

Alito is an evil little snot so of COURSE he's against anything for the greater good.

as I did this morning at the park with a lawyer colleague/friend of mine. He thinks 5-4. I think it would be beyond defensible for even the most RW-leaning judges, but no doubt Thomas & Alito will find a way.
