If I were to be serious, I'd say the dinstinction lies in who's being targeted and who's doing the targeting. The Leviathan kills; a man can only murder. The Leviathan taxes, a man can only extort. The Leviathan makes order by its very nature; a free man either can comply with the Leviathan or he becomes an agent of chaos.
