Having said that, since the Fourth Amendment prohibits cruel and unusual punishment, we can't just order the bastard to commit Seppuku in the flower bed at Walter Reed. So prison will have to do.

And it'll have to be solitary confinement because any cellmate he might have would have a good Fourth Amendment case of his own.
