Fired Omaha police officer faces felony charge of evidence tampering

Two fired Omaha police officers have been charged in connection with the controversial arrest of three brothers in north Omaha.

Douglas County Attorney Don Kleine announced Monday that he had charged former Officer James Kinsella with felony evidence tampering and two misdemeanors — obstructing governmental operations and theft — for taking a memory card that contained videotape of the brothers' arrest March 21 near 33rd and Seward Streets.

Kleine said he also charged Sgt. Aaron Von Behren with two misdemeanors — obstructing governmental operations and misdemeanor accessory to a felony.

If convicted, Kinsella would face up to five years of probation or 20 months to five years in prison on the felony, and up to 18 months in jail on the misdemeanors. Von Behren would face up to two years on probation or a year in jail on each charge.
