(22,000 posts)Did you hear how similar the language in the calls were? It is really quite errie how he repeats the same thing.

(11,065 posts)The jury isn't allowed to know anything about this argument.
THe prosecution is arguing that they should be admitted because they go to Zimmerman's state of mind when the incident with Martin took place. That his frustration over the "punks" always getting away contributed to why he decided to chase Martin when he had not done this before. The prosecution also provided many relevant cases where it was ruled that such information should be heard by the jury.
The defense argued that the calls have nothing to do with Zimmerman's state of mind and that the prosecution only wants them entered into evidence to assail Zimmerman's character. I don't know if the defense offered any relevant case law or not since I got so sick of listening to O'Mara that I skipped past his blathering.
The judge postponed ruling on this so that she could review all the case law submitted and the law after hearing these calls to determine if they should be entered into evidence or not.
That bit is on this section of the trial...
croakerqueen is great at taping these interesting trials and is really quick to put them on YouTube. I watched all of the Jodi Arias trial at my leisure thanks to her putting it all on YouTube. She doesn't delete sidebars and recesses though, but you can just buzz forward through those boring bits anyway.
There were a lot of these mid-trial hearings during the Jodi Arias trial sometimes just without the jury and sometimes in chambers secret from everyone.
So far, I haven't gotten passed this section of Day 2, so I don't yet know if the judge ruled on this later in the day or how she might have ruled.
