Texas abortion law won't go through if 13-hour filibuster succeeds
Texas state Sen. Wendy Davis (D) must speak nonstop for 13 hours without bathroom breaks or leaning on anything if she wants to halt passage of a major abortion bill that would solidify Texas status on a growing list of states passing restrictive abortion measures.

UPDATE 2:45: Sen. Davis continues her filibuster at the Senate, still reading from testimony denied at last week's House committee hearing. Davis wept reading particularly emotional testimony; several observers noted that Lt. Gov. David Dewhurst chatting cheerfully on phone while Davis spoke. Latest rumor that there may be a move to cut off debate.
Worth noting is that the testimony from hundreds of Texas citizens, primarily women, is that it is marked by thoughtful and knowledgable commentary on not only the abortion issue, but the personal experiences of women who have had to make the difficult choice of seeking an abortion, often doing so in conditions designed to make it even more difficult and dangerous.
UPDATE 1:12pm: After a brief interruption when a man shouted "Abortion is genocide
if you really cared about women you would ban all abortion" from the gallery (he was ejected), Sen. Davis continues to speak, now reading from the testimony of witnesses who were not allowed to speak in House committee hearing last Thursday, because chair Rep. Byron Cook ruled they had become "repetitive."
A little after 11am, when the Texas Senate was gaveled into order, SB5 was "laid out" by its sponsor, Sen. Glenn Hegar, R-Katy, and then Davis rose "to humbly give voice to thousands of Texans."
Davis will have to speak essentially nonstop, with no breaks of any kind, until midnight, if Senate Bill 5 a bill that would greatly restrict access to abortion and basic women's health care is to be blocked from passage in this special session. The Republican leadership chose not to call up pending transportation and capital punishment bills, which would have passed suggesting that Gov. Rick Perry intends to call another special session immediately or shortly after this one ends, with additional legislative "reason" to do so.

13 hours is a long time to stand and speak. I feel so sorry for her for having to do this, but I SO hope she has the strength and perseverance to get through the remaining hours because she is doing this for women everywhere!

(17,576 posts)It frightens me the lackluster degree of involvement that some of the generations born after that time frame have about this issue. My fear is that they won't miss having the right to choice until that right no longer exists.
For you and me, this brings back the feelings of anger, disgust and horror. How dare some idiots who don't even know what a rape kit is for be responsible for deciding what is best for women.
And IMHO there is another aspect to all of this. How dare those same idiots bear judgment on those of us who may have made a choice after Roe v. Wade became law. And that is, essentially, what they are trying to do. Not only are they trying to keep young women from having choice available today, but they are making a commentary against any woman who has exercised her right of choice in the past.

And I'm afraid this is NON-NEGOTIABLE. There can be no compromise. This is an ABSOLUTE. A woman's right to have the last word, the ultimate jurisdiction, the final say (or as my mother used to put it, "say-so"
over HER own body is an ABSOLUTE. We're not asking for the last word on anyone else's body. But then again... maybe that's part of the problem?
Maybe we women ought to start legislating what the scrotum and penis can do, and what's done to it. How 'bout WE decide for the men - to "help" them or "protect" them, because they can't possibly understand on their own. How fucking cavalier is THAT? If I were in the legislature, I'd tack amendments galore like that onto everything. I'd be the biggest pain in the ass the menfolk had ever encountered. And I'd want to answer everything they did, with MY version of it, going back the other way at them.
Taste of their own medicine. See how they like it.

(17,576 posts)She has to stand, cannot lean against a desk, and cannot leave the floor. Do you know if any fellow Democrats have asked questions? The local newspaper article this morning said that her colleagues could ask questions in order to allow her a few minutes to rest her voice.
I know the opposition has been asking questions trying to fluster her, but has she received any help from Dems? I'm at work and haven't been able to watch much of the video.

Politically, religiously, socially, women are being made casualties of narrow, pro-andrist, hypocritical morality that is determined to earn its virtue by destroying *other people's* lives.

I hope her legs hold out, too. I'm not too concerned about her having to eat, but not having water is just cruel. It wouldn't surprise me if a rethuglican turned up the thermostat on her. It's hard to stand for that long.

Strong hint that Republicans are considering a move to cut-off debate, although Senate rules prohibit end of a filibuster absent a yield of the speaker. Davis responds that the "little-d" democracy of Texas has been violated by this forced legislative process. Deuell increasingly testy; Davis calmly responding that she believes she is speaking on behalf of people who otherwise have no voice.

Awesomely feisty Senator Wendy Davis began the filibuster that will hopefully derail the vote at 11:18 a.m. CDT Tuesday. She sent us a statement outlining her plan for the day (which won't involve eating, drinking, sitting, or peeing):
Today I am going to talk about the path these leaders have chosen and about the dark place it will take us. I will try to explain the history of the failed legislation before us, the impact of that legislation and, most importantly, what history tells us about these policies and the motivations behind them. They do real damage to our state and to the families whose rights are violated and whose personal relationship with their doctor and their creator are being violated.
Davis has been sharing some harrowing stories illustrating the importance of access to reproductive health, but she has an incredible story of her own: she was once a single teenage mother working two jobs, but eventually became the first person in her family to earn a bachelor's degree, not to mention graduate with Honors from Harvard Law and get elected to the Texas Senate in 2008. She's staged a successful filibuster before; we're confident she can do it again.
A brief reminder of how overwhelmingly shitty this bill is: it would ban abortions after 20 weeks of pregnancy, mandate that clinics complete unnecessary upgrades, require doctors to gain admitting privileges at hospitals, and place new restrictions on medication abortion. Abortion advocates say it would close all but five clinics in the state.

(43,307 posts)have merit. The bill's impossible requirements for doctors seems intended to discourage doctors from fulfilling their hippocratic oaths and quality care for their communities.
I particularly like her classy description of "legislators in their wisdom" legislating another profession about how to do its job.
It's not as if these shameless men can be made to feel guilty about their arrogance and abuse of power, but she's damned sure showing the rest of us how to do it elegantly.
She's so admirable. Lively. Fascinating. I just can't look away.

(64,362 posts)Raised a point of order questioning its germaine-ness to the bill. The issue was the requirement of a patient to return back to the doctor that prescribed RU-486, which is unnecessary. After the termination, the patient needs periodic blood tests to make sure her hcg levels return to normal. Davis spoke of the unnecessary hardship of having to return back to the doctor after other hardships, such as the requirement of a sonogram, then a return a day later for the procedure or prescription.

This is exciting, even though it's slow going. Still, gotta support Wendy Davis.

How long can someone standing straight and speaking a bill to death hold our interest? For a long time, it turns out. Sen. Davis started by reading (very slowly) the letters from the Texas Medical Association, the Texas Hospital Association, the Texas chapter of the American College of Obstetricians and Gynecologists (ACOG), and others, criticizing various aspects of the bill. Then she switched to reading the personal testimonies of members of the public who had tried, and failed, to give public testimony at the House committee hearing last Thursday. Some of the stories were so heart-wrenching that Davis cried openly, as did many in the gallery.
But besides tears, theres also been a great deal of nail-biting to hold public interest. Rumors flew about earlier today suggesting that Republican senators might find a procedural loophole to break the filibuster. A fevered examination of the Senate rules suggests that loopholes might exist, but would they be used? Breaking a filibuster would be a huge departure from Senate tradition and set a precedent for any future filibusters. Are Republicans willing to go that far for SB 5, especially given that Gov. Rick Perry can call another special session of the Legislature to pass the bill?

There was a show on the Science Channel explaining various scientific philosophies of when life begins. Some doctors conclude that life begins with sentience. Others think it is later, when a child becomes self-aware.

More points of order, Duncan has returned the floor to Watson. Estes is still working to table Watson's motion to appeal the third point of order. Let's hope that he can stay talking for another 30 minutes or so. If he does hold the floor, then votes would have to be taken on the motion to table by Estes, Watson's motion to appeal, closing the debate and then voting on the actual Senate bill.
It looks like the Democrats will be able to run out the clock with 40 minutes relating.
Meanwhile on the live blog, it mentions that the Texas DPS has locked the doors to the gallery. Anyone that leaves the gallery not be readmitted. I think that Watson can hold the floor for that time.

It looks as if the balcony refuses to abide by the senate president's rules of etiquette and intends to make the final SB5 vote as difficult as possible.
If this president tries to get the public in line, he's going to face opposition, and maybe the public will fight with security.

Everyone is still just milling around. I think I heard someone threaten the gallery that they could all be arrested. Much laughter ensued.

(275 posts)just because its ok for GOP'ers to do these kinds of things. The moment a democrat is thought to have POSSIBLY done something like this there will be an uproar talked about for weeks.

(37,748 posts)I though the same thing about DeLay when he sent Homeland Security after a handful of Texas Democrats who left the state to avoid a quorum for a vote on a gerrymandering bill (which passed, but was later overturned by the courts).
But they got away with it.

(275 posts)... especially in our government. Those in power in state, from what I'm starting to see, have complete control over everything really. I suppose maybe holder or someone higher might be able to do something but they'd rather do things like bust mmj clinics.
A real hero.
How the heck did she manage not to go to the bathroom that long?
