Thread in support of Sen Davis who must filibuster (no breaks) 13 hours to kill TX abortion bill

Texas abortion law won't go through if 13-hour filibuster succeeds

Texas state Sen. Wendy Davis (D) must speak nonstop for 13 hours – without bathroom breaks or leaning on anything – if she wants to halt passage of a major abortion bill that would solidify Texas’ status on a growing list of states passing restrictive abortion measures.

UPDATE 2:45: Sen. Davis continues her filibuster at the Senate, still reading from testimony denied at last week's House committee hearing. Davis wept reading particularly emotional testimony; several observers noted that Lt. Gov. David Dewhurst chatting cheerfully on phone while Davis spoke. Latest rumor that there may be a move to cut off debate.

Worth noting is that the testimony from hundreds of Texas citizens, primarily women, is that it is marked by thoughtful and knowledgable commentary on not only the abortion issue, but the personal experiences of women who have had to make the difficult choice of seeking an abortion, often doing so in conditions designed to make it even more difficult and dangerous.

UPDATE 1:12pm: After a brief interruption when a man shouted "Abortion is genocide … if you really cared about women you would ban all abortion" from the gallery (he was ejected), Sen. Davis continues to speak, now reading from the testimony of witnesses who were not allowed to speak in House committee hearing last Thursday, because chair Rep. Byron Cook ruled they had become "repetitive."

A little after 11am, when the Texas Senate was gaveled into order, SB5 was "laid out" by its sponsor, Sen. Glenn Hegar, R-Katy, and then Davis rose "to humbly give voice to thousands of Texans."

Davis will have to speak essentially nonstop, with no breaks of any kind, until midnight, if Senate Bill 5 – a bill that would greatly restrict access to abortion and basic women's health care – is to be blocked from passage in this special session. The Republican leadership chose not to call up pending transportation and capital punishment bills, which would have passed – suggesting that Gov. Rick Perry intends to call another special session immediately or shortly after this one ends, with additional legislative "reason" to do so.

13 hours is a long time to stand and speak. I feel so sorry for her for having to do this, but I SO hope she has the strength and perseverance to get through the remaining hours because she is doing this for women everywhere!

It frightens me the lackluster degree of involvement that some of the generations born after that time frame have about this issue. My fear is that they won't miss having the right to choice until that right no longer exists.

For you and me, this brings back the feelings of anger, disgust and horror. How dare some idiots who don't even know what a rape kit is for be responsible for deciding what is best for women.

And IMHO there is another aspect to all of this. How dare those same idiots bear judgment on those of us who may have made a choice after Roe v. Wade became law. And that is, essentially, what they are trying to do. Not only are they trying to keep young women from having choice available today, but they are making a commentary against any woman who has exercised her right of choice in the past.

right to decide what happens to OUR OWN PERSONAL BODIES. That piece of real estate between the neck and the knees. On a woman, that particular territory belongs TO HER AND HER ALONE. And it's HER decision what happens with it, and within it.

And I'm afraid this is NON-NEGOTIABLE. There can be no compromise. This is an ABSOLUTE. A woman's right to have the last word, the ultimate jurisdiction, the final say (or as my mother used to put it, "say-so&quot over HER own body is an ABSOLUTE. We're not asking for the last word on anyone else's body. But then again... maybe that's part of the problem?

Maybe we women ought to start legislating what the scrotum and penis can do, and what's done to it. How 'bout WE decide for the men - to "help" them or "protect" them, because they can't possibly understand on their own. How fucking cavalier is THAT? If I were in the legislature, I'd tack amendments galore like that onto everything. I'd be the biggest pain in the ass the menfolk had ever encountered. And I'd want to answer everything they did, with MY version of it, going back the other way at them.

Taste of their own medicine. See how they like it.

She has to stand, cannot lean against a desk, and cannot leave the floor. Do you know if any fellow Democrats have asked questions? The local newspaper article this morning said that her colleagues could ask questions in order to allow her a few minutes to rest her voice.

I know the opposition has been asking questions trying to fluster her, but has she received any help from Dems? I'm at work and haven't been able to watch much of the video.

I can't believe I am living in a time where this is even an issue any more. How can anyone even begin to think of America as the "land of the free" without first having the freedom of control over your own body?

She looks tired. I am hoping she will be buoyed up by all of the support and be able to accomplish the super-human feat of remaining on her feet for the next seven hours.

This has never been merely "choice" or privacy, in my mind. It is a life or death matter for Women. It is and has always been clear that the powers that aim to ban safe abortion are united in the sick belief that women aren't really people; rather, we are an expedient.

I hope her legs hold out, too. I'm not too concerned about her having to eat, but not having water is just cruel. It wouldn't surprise me if a rethuglican turned up the thermostat on her. It's hard to stand for that long.

Texas is the frontline in the war against women. I live in a rural area where PP is basically the only access to health care poor women have and Rick Perry has made that wonderful organization a whipping boy (girl?) for his grandstanding egotistical presidential ambitions.

have merit. The bill's impossible requirements for doctors seems intended to discourage doctors from fulfilling their hippocratic oaths and quality care for their communities.

I particularly like her classy description of "legislators in their wisdom" legislating another profession about how to do its job.

It's not as if these shameless men can be made to feel guilty about their arrogance and abuse of power, but she's damned sure showing the rest of us how to do it elegantly.

She's so admirable. Lively. Fascinating. I just can't look away.

Raised a point of order questioning its germaine-ness to the bill. The issue was the requirement of a patient to return back to the doctor that prescribed RU-486, which is unnecessary. After the termination, the patient needs periodic blood tests to make sure her hcg levels return to normal. Davis spoke of the unnecessary hardship of having to return back to the doctor after other hardships, such as the requirement of a sonogram, then a return a day later for the procedure or prescription.

Watching a filibuster ought to be boring. After all, according to Senate rules, a filibusterer may not eat, drink, lean, speak softy, stray off topic or take a bathroom break. Any violation of these rules or break of more than five seconds could allow another senator to call for a vote and pass the bill. And there’s no question SB 5 has the votes to pass. It’s all up to Davis. She must keep going until midnight, when the 30-day special session of the Legislature called by Gov. Rick Perry ends.

How long can someone standing straight and speaking a bill to death hold our interest? For a long time, it turns out. Sen. Davis started by reading (very slowly) the letters from the Texas Medical Association, the Texas Hospital Association, the Texas chapter of the American College of Obstetricians and Gynecologists (ACOG), and others, criticizing various aspects of the bill. Then she switched to reading the personal testimonies of members of the public who had tried, and failed, to give public testimony at the House committee hearing last Thursday. Some of the stories were so heart-wrenching that Davis cried openly, as did many in the gallery.

But besides tears, there’s also been a great deal of nail-biting to hold public interest. Rumors flew about earlier today suggesting that Republican senators might find a procedural loophole to break the filibuster. A fevered examination of the Senate rules suggests that loopholes might exist, but would they be used? Breaking a filibuster would be a huge departure from Senate tradition and set a precedent for any future filibusters. Are Republicans willing to go that far for SB 5, especially given that Gov. Rick Perry can call another special session of the Legislature to pass the bill?

Duncan is now emphasizing the rules of decorum in the gallery and chamber. Duncan is threatening to clear the gallery be cleared. So much for transparency in the government.

When you look at the early stages of pregnancy, there is barely any life at all there. It's a blueprint, that's all. It takes months and everything working perfectly to go from a fertilized to a human being.

There was a show on the Science Channel explaining various scientific philosophies of when life begins. Some doctors conclude that life begins with sentience. Others think it is later, when a child becomes self-aware.

These bible-thumpers are pushing their religious beliefs on everyone else and getting away with it.

I'm looking to leave Texas. Too many assholes in charge.

Whitmire is also speaking and now Senator West.

Estes is trying to table the motion made by Watson to appeal the decision of the chair. Watson was recognized to make the motion and he yielded to Whitmire. Watson did not yield to Estes.

The worst part of this for me is that nutbag Donna Campbell who called that 3rd point of order (POO) on Senator Davis is the tea party nutbag that is supposed to represent me. The nut bag wasn't even taking calls from some of her Austin constituents.

To have her take Wendy down just breaks my heart.

Loving that the Democratic senators are making this fight. Kudos to Davis, Watson, West, Van de Putte and Zaffirini.

33 minutes to go. It looks like the Republicans have realized that they blew it because they haven't interrupted Watson in about 15 minutes.

Watson is having a good time making his point for germaneness.

Estes is now trying to force his motion to table again.

Duncan is making a mockery of the rules, they are now calling the roll on Este's motion to table.

Roll call to table is 17 ayes and 12 nays.

Van de Putte raise another parliamentary inquiry. Van de Putte also made a motion to adjourn and saying that it takes precedence before the Senate roll call. Duncan was saying that she wasn't recognized prior to the Senate roll. More protests from the gallery.

21 minutes remain.

They are now having a roll call on whether the president's point of order about germaneness will stand.

This is going to come down to the last minute.

and it's been a hoot of parliamentary shenanigans.

THAT point exactly has been the problem... and then it was recognizing another Senator who asked to table the debate while another Senator was still in the process of debating. She is still standing I am sure or else all this would be moot. If she sits before midnight central time, it's over and the bill goes forward.

They are still discussing the appeal of the third point of order.

Senator Zaffirini (D) also became involved making points of order.

More points of order, Duncan has returned the floor to Watson. Estes is still working to table Watson's motion to appeal the third point of order. Let's hope that he can stay talking for another 30 minutes or so. If he does hold the floor, then votes would have to be taken on the motion to table by Estes, Watson's motion to appeal, closing the debate and then voting on the actual Senate bill.

It looks like the Democrats will be able to run out the clock with 40 minutes relating.

Meanwhile on the live blog, it mentions that the Texas DPS has locked the doors to the gallery. Anyone that leaves the gallery not be readmitted. I think that Watson can hold the floor for that time.

Senator Watson is pointing out the ridiculousness of repukes in Texas. How is a sonogram bill discussion not germane to a bill about new restrictions on abortion. A collective impact on procedures that impact women?

The latest loud balcony applause is over this last point of order question: " How does a female member of this body get recognized over the interference of males in this body."

It looks as if the balcony refuses to abide by the senate president's rules of etiquette and intends to make the final SB5 vote as difficult as possible.

If this president tries to get the public in line, he's going to face opposition, and maybe the public will fight with security.

The balcony people are all like "fuck your order 'so that members may properly cast their vote.' " Properly? Seriously?

I know governor good hair will call another special session and the narrow minded freaks will eventually get their anti abortion bill, I'm extremely proud of my far and few elected democrats and that fought this thing to the end and my fellow texans that sat in the lobby and yelled like the cowboys had won the Super Bowl.

the last 10 minutes that the senators had a hard time hearing and eventually huddled in a mass by the podium... I don't know what happened officially but the vote to pass the main bill in question missed the deadline. No doubt, will be brought up again but it appears - and maybe I am wrong - but appears this battle is won.

Obviously I haven't posted much but you were the first to welcome me.

Everyone is still just milling around. I think I heard someone threaten the gallery that they could all be arrested. Much laughter ensued.

I also heard a chant of "Let them vote" but it was not clear where that came from. Perhaps a gallery minority?

The People will not put up with being ignored about a constitutional right to privacy for half the population. Men have there and elsewhere have been out to show women that they don't have the same fundamental constitutional rights, but that state level power playing is going to backfire.

It will be interesting to see what the chair says when he returns to the podium. I don't see how this vote will stand since even the chair said that the Senate was not in order during the roll call vote. It's all on video in case a court needs to review.

Someone is going down. Some legislator had to authorize the change (I can't see the clerk changing the record without being told to). And committing a felony while on the job legislating surely must be an impeachable offense.

I though the same thing about DeLay when he sent Homeland Security after a handful of Texas Democrats who left the state to avoid a quorum for a vote on a gerrymandering bill (which passed, but was later overturned by the courts).

But they got away with it.

... especially in our government. Those in power in state, from what I'm starting to see, have complete control over everything really. I suppose maybe holder or someone higher might be able to do something but they'd rather do things like bust mmj clinics.
