gopiscrap
(23,733 posts)who will vote acquittal and some will vote guilty and at some point the judge, seeing that there would be no compromise will declare a mistrial and the whole case will have to be tried again.

(3,731 posts)they can either try the defendant again on the original charge, or they can charge the defendant with the lesser included charge in hopes of a conviction, or they can try to strike a deal.
gopiscrap
(23,733 posts)the charge or charges in which there is a hung jury can be re tried

(26,366 posts)If a single juror holds out and doesn't vote with the others eventually the judge will declare a mistrial.
The result is usually a retrial, trying the case all over with a different jury.

(6,229 posts)Hooray!!!
quinnox
(20,600 posts)but I think it might happen, and surprise a lot of people.

(3,731 posts)the best they can hope for at this point is Manslaughter, and with my experience in criminal trials, they'll be lucky to get that.
This prosecution has been, IMO, the equivalent of the Gang That Couldn't Shoot Straight.
quinnox
(20,600 posts)and might have seen things rather differently.
but, like I said, with my experience with testifying in criminal trials, for the state and defense, I just don't see that happening, I pray I'm wrong, but I usually have a good feel for this.
We will shortly see.

He totally took me by surprise. Distilled all
of the very best points supporting the charges.

(4,713 posts)But this case was a train wreck if I have ever seen one & I've seen some pretty crappy cases get tried. However, I do think the elements are there for 2d degree it is just going to come down to the jury's take on it & how they read the evidence.
Cross our fingers & hope for the conviction.

(3,731 posts)I expected nothing less from you, and you don't disappoint Hoyt.
Hoyt
(54,770 posts)by voting you think he will be acquitted, but when pressed say he's guilty manslaughter, or it could be 2nd degree, or some other BS.
Why don't you just come out and admit that you and your gun buddies will celebrate if he gets off. Maybe not on DU, but somewhere.
gopiscrap
(23,733 posts)that's the problem with fucking gun nuts...it's all about their god damn guns and to hell with everyone else.

(3,731 posts)I voted acquittal because that's what I believe will happen because of the ineptness of the state's case, however, I believe he's guilty of Manslaughter.
I won't be celebrating anything, which ever way the verdict turns out, nobody wins in this case, a young man is dead, and his family is devastated, another man's life is ruined no matter what the verdict is.
But you just keep on misrepresenting other people's views, you're very good at it.

(3,731 posts)I salute you for a tough and thankless job, I'm retired FLEO and you couldn't pay me enough money to do what you did.
I just have this nagging feeling that GZ is going to either be acquitted or receive a hung jury, I hope not, but my experience in criminal proceedings, tells me otherwise.
We should know shortly.
William769
(55,144 posts)I have been to more court trials than I care to remember. It's just a feeling I got but like I said, I could be wrong.

(3,731 posts)We'll know soon enough.

(20,277 posts)I decided to go with manslaughter. Bubba still gets time for that.

(2,201 posts)I really wish there was a recording somewhere of the phone call between Trayvon and Rachel.
Do you think if one of the Attorneys subpoenaed the NSA for a recording of the call, they'd give it up? (That was an attempt at a joke)

(3,731 posts)I chuckled at it.

(486 posts)Considering that a couple of the state's witnesses testified that Martin was on top of Zimmerman, beating him . . . I feel like he will probably be acquitted. And I'm not sure it won't be the right call either. Just sayin'.

(13,141 posts)and he pulls a gun or you see he has his hand on
his gun in a holster and you have the chance to
be on top, restrain him, and you try like hell to pin
his arms so he can't aim that gun at your heart...
yeah that works for me.
I don't think there was amoment from the time
Zimmerman got out of the car that he took his
hand off his gun. He was ready set to go.
He didn't have two hands to defend himself
once the fight started because he was keeping
one on the gun.

(22,308 posts)while carrying a loaded weapon. Trying to cherrypick out one moment and presenting Travyon as the aggressor because of it isn't rational. The "Stand Your Ground" law allows people (even black people) to defend themselves against someone like Zimmerman.
Zimmerman is clearly guilty of something. Manslaughter is a bare minimum.

There must be at least ONE woman on that jury
who would not acquit in a million years.
gopiscrap
(23,733 posts)and if the state refuses to retry I think there will be a lot of protesting going on

(10,952 posts)for acquittal. Martin could not conceivably done all of the things Zimmerman accused him of unless Martin was an octopus and a dwarf. I cannot get past Zimmerman's lies and attitude.
