It gets sillier. The following Greenwald statement could be referred to as an outrage sandwich: two outrageous claims surrounding a throw-away mention of delicious, meaty truth that mitigates the outrageousness of the two claims.
Its done with no need to go to court, no need to get approval. There are legal constraints for spying on Americans, you cant target them without going to the FISA court. But it allows them to listen to whatever e-mails they want, telephone calls, browsing history, Microsoft Word documents.
Put another way: No need for court oversight! (But theres court oversight and warrants.) They can listen to whatever they want! In the midst of inciting outrage, these mitigating news blips manage to pop up in nearly every article. But the blips are considerably out-gunned by all of the bloated hyperbole preceding and following each one.
Whenever the government determines theres probable cause for targeting American citizens or U.S. persons with surveillance, requests are submitted to the Foreign Intelligence Court (FISC or FISA Court) and warrants are issued. This is standard operating procedure as sanctioned by Congress. Warrants are likely the policy protections that Snowden hedged about in his online Q&A. But the hyperbole has led many Americans, and even members of Congress, to believe that NSA is eavesdropping on all of us without cause or judicial oversight.
In other words, what Snowden said in his Hong Kong video interview about his authorities to read the presidents email apparently had to do with his illegal, extrajudicial ability to do so. Snowden and others could evidently use this software (to be revealed this week) to hack into the presidents email, for example. Yet these analysts would be doing it outside the purview of American law since the president is an American citizen and targeting him for eavesdropping requires a warrant as well as this mysterious technical protection or filter (maybe Greenwald will tell us about the filter, but Im not holding my breath). Likewise, NSA analysts must attain warrants and surmount the mystery filter in order to listen to your calls or to read your emails; not unlike various legal requirements that any law enforcement official must satisfy. Its sad that we have to remind Greenwalds disciples that from low-level deputies on up, the law requires similar orders in order to conduct a search, per the Fourth Amendment, and those orders can only be attained if theres a suspicion that an American citizen might be breaking the law.
But youll never hear it described this way by Glenn Greenwald because it renders his bombshells impotent.

He then tried to do what was asked of him, which was spread the word and get it to Concord. He managed to spread the word but failed to get it to Concord himself; that was done by others. Only to the most deluded mind would an act of reconnaissance be considered "whistle blowing" against, or betrayal of, the British Crown. Indeed the British did not regard Paul Revere as a traitor because they released him after that night.
Revere regarded his government as being the Continental Congress.
Now compare to Mr Snowden who performed acts of espionage against the legally constituted government of the USA; he was not acting in the service of an alternative government in rebellion to this legally constituted government. What is more he sought protection from the consequences his spying by publicising what has been long available information about government programs that watch the actions of US citizens.

Sure, I guess it could be argued that what Snowden did was much less damaging to the gov, since he did not reveal any troop movements, however I do believe that a reasonable person can easily spot the parallels.

It betrays an utter lack of creativity on the part of the people making the accusation. They are so convinced that they are right that they cannot imagine someone else might hold a different point of view in good faith. (8,170 posts)BTW I have been posting here since prior to the 2008 election, originally to cheer for Dennis Kucinich and his proposal for a true US national health service. I have had US correspondents and friends who have suffered because of the Ayn Rand nature of US "healthcare".
My views:
1) Manning is a hero;
2) Snowden (and Greenwald) are self publicists;
3) the information about Echelon and Prism was never a revelation because all the information has been out there for years;
4) Snowden did steal, and provide to antagonistic countries, US surveillance details;
5) metadata has to be open to allow modern phone systems (and e-mails and the internet) to work;
6) open data can be used as evidence for further searches of private data;
7) if you are so dumb as to think anything you put out on the internet is private then there is a bridge in London you might want to buy.
8) The same goes for mobile phone calls, faxes and a host of other modern communications
Additionally:
A) neither Greenwald nor Snowden are in any danger of assassination;
B) the Bolivian aircraft was not refused access to airspace until after a technical issue caused it to ask for permission to vary its flight plan, whilst it was airborne;
C) scary drones are not all Predators, most are remote sensing devices doing nothing that is unconstitutional nor should it be illegal
D) the media frenzy is primarily designed to damage the President and the Democratic Party;
If you want e-mail privacy invest in a good 256 bit encryption program.

"Guardian Reader" over here refers to someone (loosely of the left) who studies the various Governmental, business, environmental and health scandals revealed by The Guardian with various levels of outrage, yet accepts (without demur) lifestyle and "alternative health tips which verge on the laughable. Most long standing Guardian readers are pretty sceptical of both types of story as often they are overblown and poorly researched. The polar opposite is the "Daily Mail Reader".
Over here "The Guardian" is often referred to as "The Grauniad" (pron. groaniad) because of past very poor editing and sub-editing.
This has been made worse by the arrival of on-line blogs, like Glen Greenwald's, which are often cited as authoritative because they appear with the kudos of "The Guardian".

In truth even this was not particularly original as "Private Eye" had been publishing about this for some years. If needed I could even say that these were not the first documented reports as tales about generic GCHQ spying had been round since the early '70s though they were ("Private Eye" excepted) were the first to mention Echelon and (RAF) Menwith Hill.
I need to pretend nothing for I do not live in a fairyland of evil governments, superhuman assassination plots and perfect secrecy. I live in a world where governments are made up of more or less fallible humans, security services hate assassination because it complicates matters as well as revealing what interests the service concerned and secrecy consists, primarily, of the majority of the public not noticing what is going on.
If I wanted to wear a "tinfoil hat" I would not (it actually concentrates rf waves in the head) but I could point to tales told me about very high quality voice recognition software used (against the IRA) back in the 70's; the Signals regiment that was completely disbanded because of espionage in its ranks; or the large void under Hyde Park, not recorded on any map, that Imperial College lecturers used to have their geophysics students detect.
Essentially; I pay attention, I listen and I remember but with the caveat that I know memory to be a flawed recording informed by current knowledge.

I know that's difficult for some to understand, especially those who feel the need to claim a greater right to post on this site, but based on your own critique, I have the better standing. Sure you've posted more comments, but looking at the quality of them I wouldn't try bragging on that score, either.
It appears you have the ability to spew insults at posters but not to actually join in with reasoned discussion. Can I suggest you take some time to learn that craft? Then explain the process to your own "obnoxious clique."

Anyone who has ever seen a phone bill knows who revealing it can be. Imagine having a list of all the websites your server has visited, all the e-mail addresses that contact yours and some details about all your internet searches.
And getting a warrant from the FISA court is obviously not that hard. If it were really difficult that court would have refused a greater percentage of the requests than it has.
From Mother Jones:
"The FISA system is broken," Marc Rotenberg, executive director of the Electronic Privacy Information Center, told the Journal. "At the point that a FISA judge can compel the disclosure of millions of phone records of US citizens engaged in only domestic communications, unrelated to the collection of foreign intelligence
there is no longer meaningful judicial review."
But according to Timothy Edgar, a top privacy lawyer at the Office of the Director of National Intelligence and the National Security Council under Bush and Obama, it's not quite as simple as the FISC rubber stamping nearly every application the government puts in front of it.
The reason so many orders are approved, he said, is that the Justice Department office that manages the process vets the applications rigorously... [S]o getting the order approved by the Justice Department lawyers is perhaps the biggest hurdle to approval. "The culture of that office is very reluctant to get a denial," he [told the Journal].

I'm sure everyone on DU would welcome your input as to what Australians and the Australian chamber of commerce think of NSA spying and Snowden's revelations of same. I would be very grateful if you posted your thoughts and opinions as an Australian on ANY of the issues discussed and debated on DU. But please honor the concept of full disclosure, (not your real name, of course) as to the perspective which informs and motivates your participation. Perhaps you HAVE posted such info in the past and I've missed it. Please include links, if possible.

In answer to yr first question: I really don't know. While I don't read even half of the posts at DU, I haven't spotted any DUers who aren't American posting aggressively defending the NSA or attacking Mr Snowden. I may have missed them, though, as I kind of work on the default here that unless someone says something to indicate otherwise, that they're American.
When it comes to what Australians (all I know of the Australian Chamber of Commerce is they whine a lot whenever workers get pay rises or better conditions or tax breaks and I'm not sure they'd have time to break away from that to be interested in the NSA or Snowden) think, I can just go on anecdotal stuff from family, friends and colleagues, and what the media says. Media first. There was lots and lots in the media when the story broke in the Guardian, the Australian govt apparently asked the US whether Australian facilities were being used to do that wholesale data mining, and there was a lot of stuff in the media on the involvement of Pine Gap and more surprising Australian bases like HMAS Harman. But it's died down over the past few weeks. When it comes to people I know, my daughter's been following it and feels the same as me about it. On the other end of the scale, we were talking about whistleblowing at work today and I rattled off some names like Mordechai Vanunu, Edward Snowden, Bradley Manning and Julian Assange. I got a resounding 'huh? who?' from most of my colleagues to all of them except Julian Assange, because of course he's one of our tribe so of course everyone knows about him...
My own views (and I find my own posts too boring to bookmark and link back to) and I've posted a few times saying this sort of thing, is that Mr Snowden's a whistle-blower and not a criminal, but that he's not what the focus should be on. It should be on what he disclosed and what the NSA is doing, which is incredibly wrong. The behaviour of the US in exerting all the bullying and temper-tantrumming to try to make other countries do its bidding would embarrass the hell out of me if I were American. Some of the stuff I saw written about South American leaders verged on racist and of a colonial mindset, imo. And all that while the US harbours war criminals and those who've taken intelligence from their own countries to the US. It's so hypocritical. So my hope is that the brakes are put on the powers of the NSA, and that Mr Snowden lives a long and happy life far out of the reach of the US....
If you want to see ANY of the issues I've discussed in my more than ten years at DU, I'm all over the old I/P forum at DU2 where I was called a terror apologist, Hamas lover, and all sorts of other things that make these inane Snowden related back and forths of 'Sock puppet!' 'Snowden apologist!' 'Paid shill!' and on and on look very mild. One thing I learnt in the rough and tumble I/P forum of the early years of DU was that while it might feel great to tell the opposing side what a bunch of wankers they are and how you'd get more value out of watching an episode of the X-Factor than reading their repeat-it-by-rote crap, people stop listening to you if all yr doing is flinging poo around. And as more than likely yr opposition aren't going to be swayed by anything you say when you do discuss whatever issue it is, it's people reading and not posting much that need to be the audience to keep in mind. I'm part of that audience, and the incessant insults and attacks I see seem to be the furthest thing possible from the actual issue of Snowden and the NSA. If the person I replied to originally hasn't nodded off of boredom before they get this far, I hope they keep that in mind when they post

Ex-NSA contractor and whistleblower Edward Snowden has disclosed his first set of documents outlining Australias role in NSA surveillance programs, picking out four facilities in the country that contribute heavily to US spying.
The locations of dozens of the USs and associated countries signal collection sites have been revealed by Snowden, who leaked classified National Security Agency maps to US journalist Glenn Greenwald, which were then published in the Brazilian newspaper O Globo.
The sites all play a role in the collection of data and interception of internet traffic and telecommunications on a global level.
Australian centers involved in the NSAs data collection program, codenamed X-Keyscore, include Joint Defence Facility Pine Gap in central Australia and three Australian Signals Directorate facilities: the Shoal Bay Receiving Station in the countrys north, the Australian Defence Satellite Communications Facility on the west coast, and the naval communications station HMAS Harman outside the capital, Canberra

We have a bunch of people on both sides really posting a shitload about this guy and to say that one particular poster should be kicked off DU for it just seemed especially hateful. Ive seen that damn list in multiple threads and never commented in on it. It gets posted and *poof* the pile-on begins.
I in no way meant it as a slight against Catherina. Ive had good conversations with her. And I really dont care how much a DUer posts on a subject that interests them. But the someone alert mirt bs... well, I had a moment. I hope you understand.

The details about the robosigning, it's all there in the information that has been released. The analysts simply fill out a form or template and they have immediate access to the contents of emails and phone calls.
The template or form drives all of the computer modules that compile all the information needed for requesting a warrant from the FISA court. This ensures that the requirements for the warrant are complied with.
Then, sometime during the following 72 hours, the warrant request is sent to the FISA court. It is automatically approved since all the "legal" requirements have been met when the analyst completes the form or template that starts the process. I imagine thousands of communications can be requested by a single warrant.
Any analyst is authorized to obtain the content of any voice or email record, on his own authority, if he has been verbally authorized to do so by either the Attorney General or the Director of National Intelligence.
It's all covered in the FISA law itself, and then made crystal clear by the document releases that Snowden made. The laws were already known, Snowden explains the policy used to implement the law, which I never heard anything about before his disclosures.
If you are familiar with how robosigners were used to flout legal hurdles in the home repossession scandals, then you have to understand that this system of having the analysts become robosigners is done for exactly the same purpose. The only difference being that in the NSA spying case the robosigning has been made the official policy, which I think makes it legal, even though it violates the spirit of the law.
The policy could be ruled illegal by the Supreme Court, but no one has been able to argue the case there because all Americans lack legal standing.
One of the documents that Snowden released was the Verizon warrant which should provide legal standing to Verizon customers since they can now prove to the court that they are being targeted. In the past the court denied standing to everyone because no one could really know whether or not they were on a list since it was all secret.

It's a completely automated system where the analyst fills out a form or template and by doing so all of the legal requirements established by the FISA court are automatically met. The information contained in the form or template is forwarded to the FISA court for their automatic approval at a later date, usually within the next 72 hours.
I honestly thought you were beginning to understand how the system works.

(1,716 posts)It would probably be a good bet that he was deeply involved in setting up a lot of the PRISM software modules himself. Someone had to do it, and he seems to have the appropriate skill set. There would be many stages to the development, including a validation and verification processes. It probably would have involved a lot of people over several years. He did work for the NSA during the appropriate time period.
The PRISM software appears to be designed to meet all of the legal requirements that have been established in order to satisfy the FISA court. The NSA would have been the customer for this software design. This puts Snowden squarely on the customer's team during most of the development, and the customer's team would have been the ones who had to be satisfied with the performance of the system.
This would also explain why he later took the job as an analyst. This would be in order to validate for himself that all of the procedures, policies, and protocols, all of which were anticipated when the software was designed, had actually been implemented in its use.
Snowden could easily be one of the most knowledgeable people around when it comes to understanding how all of the legal and policy issues are intertwined inside the PRISM software and user protocols.
