In court documents, attorney Harvey Berger said the allegations of sexual harassment against Filner "have been so widespread, unrelenting, intense, and outspoken, that there is reason to believe that an impartial trial cannot be had in San Diego."
The area in which Filner represented as California's 51st Congressional District prior to becoming mayor includes Imperial County.

Okie dokie, things are getting hot now, as in real hot. I gotta wonder, how soon charges (criminal) are coming?
Though I think the lawyer gave up in trying to try the case in the san diego media...

(57,760 posts)This evidently refers to a civil lawsuit, but the man assaulted women and should be charged criminally.

(4,462 posts)Is Filner sufficiently wealthy and able to afford both a proper defense of all these sexual harassment claims and payment of any damages if found liable?
I recall an earlier story where he wanted the city to defend, and maybe even indemnify, him for the claims. As we are up to claim no. 11, his potential damages could easily be in the 7-8 figure range, without legal fees.
As to the change of venue for the lawsuits, it is definitely an appropriate motion, even though I would welcome him being judged by the very electorate he has so badly disappointed.

(154,021 posts)And he has a city pension from his years in city council, and another from the school board.
Also there is only one person filing civil suit. What should worry Filner is a criminal complaint, more than the civil one. IMHO that's coming. The Sherriff's are hardly done.

(4,462 posts)The attorney is me is just starting to become interested in the legal minutia.
Also, are other civil suits expected, or will the statute of limitations protect him from the remaining known claims?
BTW, you knowledge, and patient willingness to inform the forum, about Filner is invaluable. Thank you.

(154,021 posts)And Tyler, the woman who came out yesterday, while within the statue for civil complaint, retained her for other reasons. Tea leaves, after the presser they went to talk with the detectives.
As to the minutiae, the civil complaint is on channel ten site, I think we also linked to it.
Channel ten also has other released documents.
The civil complaint reads like a bad porn flick. As a lawyer I am sure you read them...as a reporter some of the details, like asking Jackson to come to work sans panties was TMI.
But the letter with the Housing and Fair Employment with complaint, and the intent to sue are part of the package.
My very much lay opinion, his lawyer tried to try this in the media, backfired, partly due to the eeeewwww factor, and now is looking for ...greener pastures.
