FLORIDA Woman catches road rage accident on video

Tampa, Florida -- A woman, who fell victim to a case of road rage on a rainy day, witnessed what she called "instant karma" when the tailgater lost control of his truck and crashed into a pole on the side of a Tampa highway -- and she caught it all on video.

The woman, who has asked to remain anonymous, posted the video on YouTube Wednesday under the title, "Redneck Road Rage/Instant Karma," explaining how the driver of the truck tailgated her for about three minutes as she drove on US Hwy 41 in Tampa. After about a minute, she says she pulled out her cell phone and recorded his actions which included staring her down and giving her the middle finger as he passed her multiple times.

It was when he appeared to try to cut her off that he lost control on the slick, wet roads and traveled across the northbound lanes and onto the grass shoulder where he took out a light pole that collapsed into the roadway near Gibsonton Drive.

After the accident, the woman pulled over to wait for Florida Highway Patrol troopers. While waiting for them to arrive, the driver of the truck took off, but thanks to her video, they were able to track him down.

Troopers arrested 33-year-old Jeffrey White at his Tampa home Wednesday for leaving the scene of a traffic crash, careless driving and failing to wear his seatbelt.

From the Florida Driver's Handbook: http://www.123driving.com/flhandbook/flhb-passing.shtml

"Passing on the right is only legal when there are two or more lanes of traffic moving in the same direction or the vehicle you are passing is making a left turn. Pulling off the roadway to pass on the right is against the law."

However that does not change the fact that the left lane is a passing lane on all two (or more) lane roadways. Not just limited access highways like the interstates. Yes the left lane can be used for turns and whatnot, however it is not a travel lane, it is still a passing lane.

Police acknowledge, if only privately, that people drive over the speedlimit. And forcing traffic down to that level causes traffic jams and pile-ups. (And a fair amount of road rage)

My own observation is people travel at the enforcement limit. That speed just short of where the police will enforce the limit. Perhaps what we really need is some honesty in signage. Cause traveling 65 in the left lane when all the locals know the police won't do anything short of 85 is a problem. (My daily commute) The other highway I travel daily has a lower speed because the police on it enforce at 70.

Fri Mar 28, 2014, 09:38 AM

There are two (or more) lanes for a reason. The faster vehicles drive in the inside lane and the slower ones on the outside. Those looking for an exit and causing the extra congestion, because the think they need to stay in the outside lane as other vehicles merge try to merge with people trying to obey the law.
What is especially bad are the "courteous" drivers that try to match their speed with those merging. It blows the timing of those merging and closes the 'hole' behind them for the next merger, sometimes leaving them with no place to go.
Obeying that law smacks of weaving in and out of traffic, which in itself is dangerous.

it's my pet peeve since i regularly drive out on a two lane road for 90 miles in each direction and there's always at least one driver cruising in the left lane, forcing people to pass on the right.
i've said it a thousand times and so many people just do not know or do not care. if someone's going faster than you: get over. i don't care if you're doing 95 and they're doing 100. get over.
people need to know this rule of the road and drive accordingly.
the guy in the truck should of course not let his rage make him an idiot, but the driver with the video should have changed lanes probably a long time before she started shooting the video.

It is easy to see from some of the post on this that many here don't see any problem with 1) distracted/dangerous driving while using cell phones, 2) left lane squatting is not a problem.

I am sure that in the 10's of thousands of miles I drive annually, I have encountered some of you sitting in the left lane, keeping the rest of us from breaking any laws. All you are doing when you sit in the left lane is cause traffic congestion and when you are recording it, you are instigating the problem.

For one thing, the frickin speed limit IS the speed limit. The fast lane does not = GO AS FAST AS YOU WANT lane. It means you are still supposed to obey the limit. She was.

Additionally, she was passing two trucks, which were going very slow due to road conditions. I saw a statement from her where she said the roads were very slick and she didn't want to risk going much faster just to pass the truck. It is not her duty to put her own life at risk so a tailgaiter can get to the beer store any faster.

I get as pissed as everyone else when I'm in a hurry on the interstate and someone is gumming up the fast lane, but that doesn't mean it's okay to ride somebody's ass and put others at risk. But this was a highway with left hand turns, not an interstate. There has to be an expectation that you may have to slow down, speed demons.

So, yeah, if you ride my ass when I'm trying to pass another vehicle safely and then make a left turn, you're the moron. When people ride my ass, I go slower. Tailgaters are asswipe control freaks who should plan their days better so they don't turn the highways into goddamn death traps.

STAY OFF MY ASS and plan your trip better. Your car is not your frickin weapon

Fri Mar 28, 2014, 03:25 PM

Since this case is from Florida, here is the Florida Drivers' Handbook:
http://www.flhsmv.gov/handbooks/

The relevant section here states:
"Passing on the right is only legal when there are two or more lanes of traffic moving in the same direction or the vehicle you are passing is making a left turn. Pulling off the roadway to pass on the right is against the law."

This is not unique to Florida. The law in most states allow cars in the right lane to travel faster that cars in the left (or middle) lanes of the road. The confusion and misinformation spreads from the concepts of passing when there is only one lane going each way - you are then required to pass on the left (by moving into the lane of oncoming traffic) and are prevented from passing on the right (by driving on the shoulder of the road).

Given that the road was clear of vehicles behind them and the fact she stated that he had been tailgating for 3 minuted prior to the video starting, she had been keeping up that rolling roadblock for about 4 miles given her speed.

If not then your post is invalid. If she was driving the posted or even exceeding the limit then she was lawfully driving her vehicle in whichever lane she chose.

Georgia I believe just passed a "slow poke" law that requires drivers, even if they are driving at or exceeding the posted speed limit, to move over to allow traffic to pass even if that traffic is not law enforcement or emergency.

I don't drive in the left hand lane but I frequently have the driving "holes" who come up on my tail and are trying to swerve to the left or the right to get around me. I let them only to see they are never more than 1-2 car lengths ahead of me when we exit or approach an intersection. I just laugh at them.

95% of the time they are either SUVs or pick-ups. This suggests to me that drivers of those vehicles should have a 500% premium attached to their insurance because they are more likely than not to be aggressive and in need of a good smack down.

on the right - you do that in the left lane, if I'm not mistaken.

As soon as she gets ahead of the second slower vehicle, which is in the right hand lane, Florida Man swoops in front of the slower vehicle and occupies the right-hand lane. She couldn't have gotten over if she wanted to. Florida Man was blocking her access to the right-hand lane. Check out 1:03 in the video.

Here's a screen grab from 1:02 - it shows two trucks to the right of her- she has just passed 'em. Florida Man is beginning to make his big move to occupy the lane to the right.

Nobody should swoop into the right lane that close to a vehicle they've just passed. It looks like his truck bed will hit the vehicle in the right-hand lane.

The speedometer indicates that she's going about 57 to 58 MPH. We know it's in traffic with wet road conditions. She's not a passing-lane slow-hog if she's driving on wet roads in traffic at 57 to 58 miles per hour, with slower trucks on the right.

So, l & p, does this give you enough proof to admit you're wrong, and retract your statement that "She was driving slower than traffic in the left lane causing traffic to pass her on the right which is dangerous. Both are assholes here!"

The only person passing her on the right is Florida Man, and he endangered the vehicle on the right by belligerently jumping in front of it.

Please, you erroneously called her an asshole. Please, do the right thing and take that back.

There is not.....There is however a slow lane. If you are driving less than the posted speed limit you should use the right lane. If you are driving the posted speed limit both lanes are appropriate. You sound like you commonly break the law while driving and thus are a hazard.

In my original home state, you cannot travel in the left lane. If there is room in any lane to the right, you are to travel in that lane. You are required to stay to the right unless you are overtaking a vehicle. In fact they just doubled the fines. So, driving the posted speed limit in the left lane will get you a ticket, as traveling in the left lane is not appropriate.

You are correct that it is not a "fast lane", it is however the "passing lane".

In this case, it is not a "passing lane". On this type of road it is considered a travel lane. And it is perfectly legal to pass other vehicles while traveling in the right lane.

There is quite a lot of confusion and misinformation about what the driving laws actually are - so it is a common misconception.

But on a road like that, where there are two or more lanes traveling the same direction, you are allowed to pass in the right lane and the left lane is considered a travel lane. When there is only one lane going your direction, you are required to pass on the left. But that's not the case here.

"Motor Vehicle Operators" and "Dumb-ass Drivers"

Of course, with so many here stating so emphatically that there is no law against driving just the speed limit in the left lane, or that there is no such thing as a "passing lane" I just had to do some research!

Misuse and common practice

Common practice and most law on United States Highways is that the left lane is reserved for passing and faster moving traffic, and that traffic using the left lane must yield to traffic wishing to overtake. The United States Uniform Vehicle Code states:

Upon all roadways any vehicle proceeding at less than the normal speed of traffic at the time and place and under the conditions then existing shall be driven in the right-hand lane then available for traffic ...

It is also illegal in many states in the U.S. to use the "far left" or passing lane on a major highway as a traveling lane (as opposed to passing), or to fail to yield to faster moving traffic that is attempting to overtake in that lane.

State "keep right" laws (from MIT)

You may use the left lane (when there is more than one lane in your direction) to pass. You may or may not be able to use the left lane when not passing. The table below describes the law in effect in each state.

A few states permit use of the left lane only for passing or turning left. These have "yes" in the "keep right" column. Six states require drivers to move right if they are blocking traffic in the left lane. Most states follow the Uniform Vehicle Code and require drivers to keep right if they are going slower than the normal speed of traffic (regardless of the speed limit; see below). These are listed as "slower", with an asterisk and an explanation under "comments" if vehicles lawfully using the left lane must yield to overtaking traffic. A few states either do not require vehicles to keep right ("no&quot , or permit vehicles moving at the speed limit to drive in the left lane regardless of traffic conditions ("<SL&quot .

The color coding in the "keep right" column is red if the state has no restriction on slow vehicles in the left lane, yellow if vehicles moving at the normal speed of traffic are permitted in the left lane even when they are unnecessarily obstructing other traffic, green if use of the left lane is limited to passing, and grey otherwise.

Map of the above laws

Now, while some may be sticklers and insist those laws are "Keep Right" and do not define a "Passing Lane", here in Texas, I have seen a few signs (not nearly as many as I would like) that state exactly "Left Lane For Passing Only." And while that does not say exactly "Passing Lane" it does seem like a pretty straight-forward definition of that to me

of -- it's 4-lane, divided, with no freeway entrances/exits -- it's intersected by roads where you can turn left and right. Thus, in my mind, 'squatting' in the left lane is not an issue. It is essentially a local road.

If anything bends ME out of shape, it's the idiot who thinks everyone else ought to jump out of his way when HE is going down the road. I've had people tell me that left-lane squatter shit applied to any 4-lane road. That's idiotic. If I'm going to turn left up ahead, I'm not gonna get in the rt lane so your precious ass can zoom by.

Some folks seem to be missing this.

Slower traffic definitely should stay out of the left lane on a limited access highway like an interstate. I'd like to see the people that hold up traffic by using it as a travel lane ticketed every single time. But this road isn't an interstate type road. Left turns are permitted from this road. Under those conditions the left lane isn't a "passing lane" or "fast lane".

That was primarily the woman's fault. Don't get me wrong, the guy's reaction was foolish and potentially dangerous. But, clearly this woman meant to provoke. She hung out in the passing lane when she had the alternative of the right lane available. She was playing miss technicality by showing herself driving 50 and baited the guy to respond rather than moving over to the slow lane. Then she stopped when he spun out to enjoy the results of her provocation. He was a jerk but, she set out to bait the jerk which was just as foolish IMO.

1) "Keep Right Except When Passing" is usually only the law on limited-access divided highways. This incident occurred on a surface street.

2) She was in the process of passing another vehicle. Passing properly & safely in less than optimal road conditions takes some time.

3) There are a million other reasons why a vehicle may be driving at or under the speed limit in the left lane. The driver doing so would not be required to justify her actions.

4) Just because another car is driving slower does not require or allow the asshole redneck to illegally & unsafely tailgate.

5) Just because another car is driving slower does not require or allow the asshole redneck to illegally & unsafely change lanes.

6) Just because another car is driving slower does not require or allow the asshole redneck to illegally & unsafely drive at excessive speed.

7) Just because another car is driving slower does not require or allow the asshole redneck to illegally & unsafely pass her on the right.

8) Just because another car is driving slower does not require or allow the asshole redneck to illegally & unsafely hang out his window flipping her the finger as he illegally & unsafely passes her.

9) Just because another car is driving slower does not require or allow the asshole redneck to illegally & unsafely neglect to pay attention to the road.

10) Just because another car is driving slower does not require or allow the asshole redneck to illegally & unsafely neglect to maintain control of his own vehicle.

The responsibility for road rage rests with the rager - not with the innocent, innocuous people who set them off.

Someone flipping another driver the finger is par for the course where I live. The way this was hyped up, I thought I was going to see actual road rage, like one car trying to run another off the road, or ramming or something, and all I got was some complete weirdo who was trying to kick something off and then cackled like she'd won Lotto when the other car went off the road and crashed.

I hope if using mobile phones while driving is illegal wherever that was, that the cops threw the book at her. That clip doesn't make either driver look good...

She was driving distracted - looking for an altercation and proud when she got one.

1) Left lane squatters are a traffic hazard where ever they are.

2) Distracted driving weather changing the radio station, texting or recording the driver behind you is reckless driving.

3) She had room to pull over because the pick up passed her in the right

Defend the left laners all you want, but they are the biggest traffic problem on the road outside of distracted/reckless drivers.

Both were at fault here and only one paid because he had a testosterone problem and lost his cool.

Fri Mar 28, 2014, 09:23 AM
Mar 2014

in the previous week (and you just know he did) was guilty of some minor infraction in his mind - either real or imagined.

And which of the drivers here was more distracted? The one who was minding the road conditions & other vehicles, driving the speed limit, maintaining a safe following distance with the vehicles in front, passing safely & staying in her lane afterward? Or the one who was busy concentrating his anger on one vehicle, speeding, tailgating that vehicle, passing unsafely, driving recklessly, not noticing the red light because he was too busy hanging out of his window flipping the woman off & who finally crashed because he couldn't control what his vehicle was doing?

I'm sorry that you feel that the mere idea of traffic makes road rage seem like a reasonable response, but the fact is the type of behavior the redneck asshole exhibited in the video kills people on a regular basis. What the woman was doing doesn't.

Your double standard is showing.

In the part of the video where her car stopped, I see a left turn arrows painted on the ground and from the view heading forward before she stops, she moved left into a dedicated turn lane.

I'd like to know the speed limit in the area -- I suspect 35-45 mph as there are houses right on side of the road -- you can see adjacent homes as he is passing and flipping her off. Definitely thankful as you noted -- would have been tragic for him to have slid right into a neighbor's yard full of children playing.

Note to tailgate addicts: If you're about to pass several trucks ( she was passing several at the time ) that are right ahead of you, and then you are in the process of passing them, and someone rides your ass while you're doing so, you CANNOT PULL OVER OR YOU WILL HIT THE TRUCKS YOU ARE PASSING. There is no physical way to "MOVE OVER." So if you're behind someone passing another vehicle or vehicles, YOU are the asswipe raging idiot if you tailgate them expecting them to speed way up on a rainy road just to pass as fast as you wish them to.

I am SO SICK of tailgaters and speed demons who use the road as their "Message to everyone who doesn't want to drive like a lunatic like me" street. Fuck that shit. This guy got what he deserved. I laughed my ass off.

I'm guessing as this goes viral, someone is going to find themselves watching from his insurance company (if he even carries it) and will make adjustments to his billing, noting his ability to drive like an adult without losing a grip. (on the road, or otherwise.)

I don't care how fast people think the passing 'should' have been occurring, on a rain-wet road, she has the legal right to drive and pass at a safe speed, not dictated by ego-maniacs who want to make life hell for others. He proved the 'safe speed' issue by spinning wildly out of control himself. I think her video showed she was not only passing at a safe speed for weather conditions, but that jerks can sometimes get their due.

has to deal with that situation as well! I went through this very thing on my commute to work this morning - a perfrectly open passing lane to the left of me, but this jackwagon had to sit on my rear bumper as I had my cruise control set at 66 mph (65 mph zone), minding my own business in the right-hand lane. He finally left the highway via an off-ramp, only after being on my tail for a good 3-4 miles.

The mega-trucks (like in the video) and full-size SUVs seem to do this disproportionately.

The day before that, I was behind a pickup with a case of water in the back of a pickup, with the tailgate DOWN. Damned thing was an accident waiting to happen as I watched that water swing back and forth all over the tailgate. Again, I pulled over to get away from the jerk and avoid that damned water going through my windshield.

as there is enough room , which to them is like a length of a car, so you just wait for them to move. I've pulled over and they will simultaneously because their idea of enough space, sitting behind me yet, is the same as mine, sitting in front of them. So I'd say she was waiting for him to pass her on the right, which he did.

It looked to me like she maintained her speed, that he sped up, then slowed back to give her the finger , then sped up to get in front of her and lost it. I get that impression cuz she states that he had been tailing her for more than a minute before she filmed, he flipped her off, he took off flying, just driving erratically in general, getting his rage on.

I used to live at the bottom of a hill where people always sped and one winter day a guy came over the hill, flying his ass off just as I was pulling out, he slammed his brakes, went sideways, then slammed into the little stone bridge. I finished pulling out and went to work. Fuck head. We lost 5 cats to those assholes.

Merely driving. On a surface road, not an expressway. I don't see how that's playing games. Some other jackass decided to start tailgating and driving up along side her and then tailgaiting her while flipping her the bird. He was doing that. Dale Mabry Highway is a north–south road in Tampa, Florida. The majority of its length consists of three lanes each direction plus a central turn-lane and often includes a right-turn lane. It begins at the MacDill Air Force Base entrance in South Tampa and ends by merging with US 41 just north of the Pasco County border.

The speed limit for most the length is 45 mph (72 km/h). * updated to note area in question is at 50 mpg but does not include the School Zone where the passing took place

That's what my mother used to say. "Stand Your Ground" attitudes do not belong on the road. When you're a driver, it's your responsibility to do everything you can to prevent accidents, and that includes disengaging from jerks. Someone could have been seriously injured here. I can't tell whether this driver had an opportunity to pull over, but if she could have, she should have. She should not have been filming while driving. She should not have stopped in the middle of the road. And a decent human being should not be laughing at another human being getting into an accident.

There was varying degrees of road rage in both vehicles. At 62 years old the two worst cases of road rage I ever witnessed both occured while on vacation in Florida which makes it long odds. I saw two incidents of drivers forced off the road and through the rear view mirror saw one driver get out of his vehicle with a club.

As far as obey the rules of the road, she did nothing wrong. That's a 4 line divided boulevard with left turn lanes. There is no requirement to "get over". There would have been no incident at all if, after he got in the right lane and passed her, he had just gone on about his business. But no, he had to be a tough guy and flip her off once he saw it was a woman. i bet if it been some guy bigger than him he wouldn't have done that.

Don't know the specifics of cell phone laws here, if she could get a ticket for using the phone while driving, but a lot of those laws are only IF you commit some sort of toher infraction while using the phone, and I saw no other infraction on her part.

"I couldn't move over because there were trucks in the right lane, and I sure as heck wasn't going to speed on a rainy day with the roads being as slick as they were. I was turning left in about a half-mile when this happened. Now bear in mind, that this guy had already passed a truck in a left turn lane, was tailgating and driving recklessly on a wet slick road, wasn't paying attention, and all in all being an ignorant ass."

If she was planning a left turn exit, then there is no need for all the "left lane hogging" nonsense displayed here.

On top of that it took her about another minute to pass those trucks in the video.

If it takes you 4 minutes to pass, perhaps you should move over and wait until there is no traffic to make the attempt.

Hard to look up and see all the DU members that think there is any justification in the actions of the angry tailgater. The guy needs some serious anger management classes and the judge will most likely assign him some if he is lucky. The whole idea that you may have a right to harass another driver because they may not be driving correctly is totally fucked up. Sometimes DU members make me wonder WTF who am I hanging out with here.

Not to mention she wasn't even doing anything wrong. You can drive in the left lane even if you aren't a speed demon. It isn't the frigging autobahn despite what some may think. I guess some people think you're supposed to somehow teleport your car to the left turn, because impeding speeders progress is the worst transgression imaginable, and whatever happens is your fault. She should have taken three right turns instead and this all would have been avoided.

Glad this gigantic asshole was caught on camera. Too bad the masses of other asshole drivers are too stupid to learn a lesson from this. That guy is lucky he didn't get shot. Way too many people carry here. His driving put others at risk of death and that could be reason for a stand your ground shooting.

What I observed...
According to her own comments on the youtube page, he had been tailgating her for 3 minutes before she started recording.
The road is empty behind them.
If you notice at the 4 second mark you will catch a glimpse of the flatbed in the right lane.
Then at the 49 second mark, she finally starts getting around the flatbed.
In between those two times she is adjusting her speed. She slowed twice then sped up at about the 45 second mark.

His actions are horrible, and there is zero excuse for them.

However, she was intentionally creating a rolling roadblock by pacing the vehicle in the right lane. If her own comments are true, then she was blocking the lane for about 4 minutes.

They are both doodie heads.

some friends and I flew to Florida once and rented a car to go exploring ...... being a passenger with her driving there was the closest I've ever come to death. Very aggressive people! Of course being from the sticks and driving mostly dirt roads didn't really prepare us.

As to tail-gating, there is nothing I hate more. We viewed dozens of videos during our training of fatalities caused because of it, being called out to deal MVA's caused mostly because the driver in front panicked and made a decision that was often fatal - so needless. When I see it on the road it gets me instantly angry. It's stupid, aggressive, bullying and most often the tail-gaiter is an asshole who cares nothing for others on the road. I absolutely hate it - anything done to stop these bullies is, imo, a good thing.

Or to flip someone off or try to cut in front of them. Someone is in the left lane but it's not fast enough? Then keep your distance and pass when it is safe. No one is entitled to the left lane. It is a passing lane but if the person in the left lane is essentially doing the speed limit there's no legitimate reason to complain and never any right to behave as this man did.

Yeah, the lady is a jerk for enjoying his rage fest.

except the guy (also in a big pick-up) passed a stream of cars on the right and then swerved into the left lane and slammed on his brakes - on I-95.

It was a miracle that everyone in our lane was able to slow down quick enough to prevent a crash. I'd never seen anyone actually try to cause an accident before.

truck and slowly passing two other trucks. Slowly passing because my truck was governed to run top speed 68 mph. The speed limit was 65 for trucks. This guy flew up behind me and started swerving back and forth. I knew he was back there and I couldn't go any faster. The guy lost his patience and passed the two trucks that I was passing in the emergency lane. Then he swerved all the way to the left lane in front of me and slammed his brakes. Not wanting to kill this idiot I drove my truck into the middle. I have no respect for people who are defending this idiot in this thread!

I am not going to defend the guys driving - he was an asshole, but why would you say he would lose his driving privileges if he had a CDL?

If he could get it out of there before any cops showed up, he wouldn't get any ticket at all. If they did show up, he might get a careless driving ticket, which doesn't look good either way, but it isn't necessarily a deal breaker.

It's lucky no one else was coming and he didn't hit anyone, but still....he spun out in the wet. It happens. If the cops got there before he was able to leave, a lot would depend on how he handled it.

and careless driving. The latter charge is 6 points alone if he has a CDL. Leaving the scene of an accident when he clearly damaged a light pole is another very serious violation and another 6 points. Add that up and you have 12 points. Not sure how many points you get for not wearing a seat belt, but you can add that to the total too!
