Martha Stewart Indicted on Criminal Charges

Martha Stewart, the home-decorating mogul who to many became synonymous with impeccable taste, was indicted by a federal grand jury today on charges of securities fraud, making false statements and obstruction of justice for her handling of a personal stock trade.

Peter Bacanovic, 41, who at the time was Ms. Stewart's stockbroker at Merrill Lynch, was charged with obstruction of justice and perjury for his role in the affair.

Ms. Stewart's lawyer, Robert Morvillo, said on Tuesday, after being advised that an indictment was forthcoming, that his client intended to fight the charges, and she pleaded not guilty at her arraignment today.

If she is convicted on all criminal counts, Ms. Stewart faces up to 30 years in prison and $2 million in fines.

NEW YORK (CNN/Money) - A jury found Martha Stewart guilty Friday on all four counts of obstructing justice and lying to investigators about a well-timed stock sale, and the former stockbroker turned style-setter could face years in jail.

Her ex-broker, Peter Bacanovic, was found guilty on four of the five charges against him. Each of them faces up to five years in prison and $250,000 in fines for each count. Sentencing is set for June 17.

Neither defendant appeared to show any emotion as the verdict was read, while the lead prosecutor seemed to be holding back tears of joy.

"The word is -- beware -- and don't engage in this type of conduct because it will not be tolerated," David Kelley, U.S. attorney for the Southern District of New York, said outside the courthouse.

One of the jurors said, "This is a victory for the little guys. No one is above the law."

Stewart speaks outside the courthouse after her sentencing, saying she'll be back.


Her declaration came in a TV interview taped hours after the homemaking diva was sentenced to five months in prison and two years' probation Friday for lying to investigators about her sale of ImClone Systems stock in late 2001.

Federal Judge Miriam Goldman Cedarbaum also ordered Stewart to serve five months of home confinement after her release and fined the lifestyle expert $30,000.

The sentence was the minimum the judge could impose under federal sentencing guidelines. The fine, while relatively small given Stewart's wealth, was the maximum allowed under federal rules.
